 AN ACT to amend the public health law, in relation to physician  course-
   work or training in nutrition
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public health law is amended by adding  a  new  section
 264 to read as follows:
   §  264.  PROVISION OF INFORMATION RELATED TO COURSEWORK OR TRAINING IN
 NUTRITION. 1. THE DEPARTMENT SHALL DEVELOP, MAINTAIN, AND DISTRIBUTE  TO
 PRACTICING  AND  LICENSED  PHYSICIANS  IN  THE  STATE A RESOURCE LIBRARY
 RELATED TO  CONTINUING  MEDICAL  EDUCATION  AND  TRAINING  OPPORTUNITIES
 REGARDING  NUTRITION,  WHICH  SHALL INCLUDE BUT NOT BE LIMITED TO PLANT-
 BASED NUTRITION AND OTHER CLINICALLY PROVEN METHODS FOR THE  PREVENTION,
 REVERSAL,  AND TREATMENT OF DIET-RELATED ILLNESSES. THE RESOURCE LIBRARY
 SHALL INCLUDE CONTINUING EDUCATION RESOURCES REGARDING  RACIAL  DISPARI-
 TIES IN OUTCOMES FOR DIET-RELATED DISEASES.
   2.  THE  RESOURCE  LIBRARY  SHALL  BE  MADE  PUBLICLY AVAILABLE ON THE
 DEPARTMENT'S WEBSITE AND UPDATED AND REDISTRIBUTED ANNUALLY VIA EMAIL.
   3. THE DEPARTMENT SHALL CONSULT WITH ORGANIZATIONS  REPRESENTATIVE  OF
 PROFESSIONS, INSTITUTIONS, AND THOSE WITH EXPERTISE IN NUTRITION AND THE
 PREVENTION, REVERSAL, AND TREATMENT OF DIET-RELATED ILLNESSES TO COMPILE
 THESE RESOURCES. COURSEWORK OR TRAINING FUNDED DIRECTLY OR INDIRECTLY BY
 COMMERCIAL  FOOD PRODUCTION ENTITIES, OR THEIR TRADE ORGANIZATIONS SHALL
 NOT BE INCLUDED IN THE DISTRIBUTED LIST OF COURSEWORK.
   4. THE DEPARTMENT SHALL CONDUCT A FOLLOW-UP SURVEY TWO, FOUR, AND  SIX
 YEARS  AFTER THE FIRST DISTRIBUTION OF THE RESOURCE LIBRARY TO ASCERTAIN
 WHAT PROPORTION OF PHYSICIANS  IN  THE  STATE  VOLUNTARILY  ENROLLED  IN
 NUTRITION  CONTINUING  MEDICAL EDUCATION COURSES AND TRAININGS TO DETER-
 MINE BEST PRACTICES FOR DELIVERING INFORMATION ABOUT THE AVAILABILITY OF
 SUCH COURSES AND TRAININGS. THE REPORT SHALL BE DELIVERED TO THE  LEGIS-
 LATURE AND MADE AVAILABLE TO THE PUBLIC.
   § 2. This act shall take effect immediately.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-

 FREQUENTLY THAN EVERY TWO YEARS VIA EMAIL.
   3.  IN  COMPILING  SUCH  RESOURCES,  THE DEPARTMENT SHALL CONSULT WITH
 ORGANIZATIONS REPRESENTATIVE  OF  PROFESSIONS,  INSTITUTIONS  OF  HIGHER
 EDUCATION,  AND  THOSE  WITH  EXPERTISE IN NUTRITION AND THE PREVENTION,
 REVERSAL, AND TREATMENT OF DIET-RELATED ILLNESSES.
   4. THE DEPARTMENT SHALL CONDUCT A FOLLOW-UP SURVEY THREE  YEARS  AFTER
 THE FIRST DISTRIBUTION OF THE RESOURCE LIBRARY TO ASCERTAIN WHAT PROPOR-
 TION  OF  PHYSICIANS  IN  THE  STATE  VOLUNTARILY  ENROLLED IN NUTRITION
 CONTINUING MEDICAL EDUCATION COURSES AND  TRAININGS  TO  DETERMINE  BEST
 PRACTICES  FOR  DELIVERING  INFORMATION  ABOUT  THE AVAILABILITY OF SUCH
 COURSES AND TRAININGS. THE DEPARTMENT SHALL MAKE A REPORT ON THE RESULTS
 OF SUCH SURVEY AVAILABLE TO THE PUBLIC ON THE DEPARTMENT'S WEBSITE.
   § 2. This act shall take effect June 1, 2024.
