TITLE OF BILL:

An act to amend the education law, in relation to authorizing certain
health care professionals licensed to practice in other jurisdictions to
practice in this state

 
PURPOSE OR GENERAL IDEA OF BILL:

To allow out of state physicians who are board certified in obstetrics
and gynecology and who are in good standing in their home state or
territory to provide reproductive health services in New York state
while waiting for full licensure.

 
SUMMARY OF PROVISIONS:

Section 1. Amends the education law by adding a new section 6529-a,
which would allow out-of-state physicians to provide reproductive health
services in this state while awaiting full licensure.

Section 2. Provides for an immediate effective date

 
JUSTIFICATION:

It is anticipated that an influx of out of state residents will seek
reproductive health services in New York State after the Supreme Court
Decision in Dobbs v. Jackson. This bill is meant to ensure that the
state will have enough providers to meet this increased demand by allow-
ing out-of-state providers to provide reproductive health services in
this state while they await full licensure.

Out of state practitioners were granted practice privileges in New York
state during the COVID-19 pandemic. They are also regularly provided
with temporary practice authority for largely attended events, such as
marathons. This bill requires that out of state physicians granted this
authority must have a pending application for full licensure with the
state education department, that they be board certified and in good
standing in their home territory or state, and that their home territory
or state have comparable licensing requirements to those required in New
York state.

 AN  ACT  to  amend the education law, in relation to authorizing certain
   health care professionals licensed to practice in other  jurisdictions
   to practice in this state

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new section 6529-a
 to read as follows:
   §  6529-A.  LICENSED  TO  PRACTICE  IN  ANOTHER  STATE  OR  TERRITORY.
 NOTWITHSTANDING  ANY  INCONSISTENT  PROVISION  OF LAW, ANY PERSON WHO IS
 LICENSED TO PRACTICE AS A PHYSICIAN IN ANOTHER STATE OR  TERRITORY,  WHO
 IS  IN  GOOD  STANDING  IN SUCH STATE OR TERRITORY AND WHO HOLDS CERTIF-
 ICATION IN OBSTETRICS OR GYNECOLOGY FROM THE AMERICAN BOARD  OF  OBSTET-
 RICS AND GYNECOLOGY, MAY PROVIDE PROFESSIONAL SERVICES WITHIN THIS STATE
 TO  PERSONS  SEEKING  REPRODUCTIVE  HEALTH  SERVICES WITHOUT FIRST BEING
 LICENSED PURSUANT TO THE PROVISIONS OF THIS ARTICLE. SUCH SERVICES SHALL
 BE PROVIDED ONLY AFTER SUCH PERSON APPLIES FOR A LICENSE PURSUANT TO THE
 PROVISIONS OF THIS ARTICLE, AS MAY BE APPLICABLE, AND  SUCH  PERSON  MAY
 CONTINUE  PROVIDING  SERVICES  PURSUANT  TO THIS SECTION UNTIL SUCH TIME
 THAT THEIR LICENSE OR CERTIFICATION TO PRACTICE IS APPROVED  OR  DENIED.
 PROVIDED  HOWEVER, THIS SECTION SHALL NOT APPLY TO PERSONS LICENSED IN A
 STATE OR TERRITORY  DETERMINED  TO  HAVE  SUBSTANDARD  OR  NONCONFORMING
 PROFESSIONAL LICENSING REQUIREMENTS, AS DETERMINED BY THE COMMISSIONER.
   § 2. This act shall take effect immediately.
