BILL NUMBER: S4506 SPONSOR: RAMOS TITLE OF BILL: An act to amend the judiciary law, in relation to the form of the juror qualification questionnaire PURPOSE: To remove the requirement for non-citizens called into jury duty to submit a form of proof that they are non-citizens and ineligible to serve on a jury. SUMMARY OF PROVISIONS: Section 1 of the bill amends section 513 of the judiciary law, for the chief administrator of the courts to only require a prospective juror to certify, under penalty of perjury, that they are ineligible to serve on a jury. Section 2 sets forth the effective date.

RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to the form of the juror qualification questionnaire THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 513 of the judiciary law, as added by chapter 86 of the laws of 1995, is amended to read as follows: § 513. Form of questionnaire. The questionnaire to be filled out by prospective jurors shall be in such form as the chief administrator of the courts may prescribe; PROVIDED, HOWEVER, SUCH QUESTIONNAIRE SHALL ONLY REQUIRE A PROSPECTIVE JUROR WHO IS NOT A CITIZEN OF THE UNITED STATES TO CERTIFY, UNDER PENALTY OF PERJURY, THAT HE OR SHE IS NOT A CITIZEN AND DOES NOT MEET THE QUALIFICATIONS UNDER SECTION FIVE HUNDRED TEN OF THIS ARTICLE. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
