BILL NUMBER: S4560 SPONSOR: MARTINEZ TITLE OF BILL: An act to amend the tax law, in relation to the public safety surcharge; and to repeal certain provisions of such law relating thereto PURPOSE: The purpose of this bill is to removes the language which requires the to state move public safety surcharge funds into the state general fund. SUMMARY OF PROVISIONS: Section 1. amends section 325 of the county law by repealing section 5(a). Section 2. amends section 6 (c) of section 325 of the county law to provide that one hundred million dollars from the 911 surcharge will be made available for the monies intended purpose.

MARTINEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Budget and Revenue AN ACT to amend the tax law, in relation to the public safety surcharge; and to repeal certain provisions of such law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 5 of section 186-f of the tax law is REPEALED. § 2. Paragraph (c) of subdivision 6 of section 186-f of the tax law, as amended by section 38 of part B of chapter 56 of the laws of 2010, is amended to read as follows: (c) Up to the sum of [seventy-five] ONE HUNDRED million dollars annu- ally may be used for the provision of grants or reimbursements to coun- ties for the development, consolidation, or operation of public safety communications systems or networks designed to support statewide inter- operable communications for first responders, to be distributed pursuant to standards and guidelines issued by the state. Annual grants may consider costs borne by a municipality related to the issuance of local public safety communications bonds pursuant to section twenty-four hundred thirty-two of the public authorities law, when the municipality has qualified as an approved participant in a statewide interoperable communications system under the standards and guidelines issued by the state, and maintains compliance with such standards and guidelines. The grant amount will be prescribed pursuant to an agreement with the muni- cipality, and may not exceed thirty percent of the annual cost borne by the municipality in relation to such bonds; § 3.
