TITLE OF BILL:

An act to amend the education law, in relation to powers and duties of
trustees; in state tuition for active and retired military members

 
PURPOSE:

Relates to powers and duties of trustees; in state tuition for active
and retired military members.

 
SUMMARY OF PROVISIONS:

Section 1 amends paragraph h of subdivision 2 of section 355 of the
education law by adding a new subparagraph 10 to read as follows:

Notwithstanding the provisions of any other general, special, or local
law, rule or regulation, such regulations shall further provide that the
payment of tuition and fees by any student in any state-operated insti-
tution of the state university who is an active or retired member of the
              

armed forces of the United States, whether or not a resident of the
state, shall be paid at a rate or charge no greater than that imposed
for students thereat who are residents of this state.

Section 2 contains the effective date.

 
JUSTIFICATION:

In honor of the service to our country, the G.I. Bill provides veterans
tuition coverage to attend a higher education institution.  The amount
given covers the in-state tuition cost. New York State requires the
residency of one year in order to qualify for the in-state tuition rate.
Therefore, if a veteran has recently moved to New York, they will need
to pay the remaining balance of being charged the out-of-state tuition
rate.

By changing New York States education law to provide that those who are
active or are a retired member of the armed forces of the United States,
whether or not a resident of the state, be charged as those students who
Are in-state residents, veterans will have the opportunity to attend a
state higher education institution with full tuition coverage.

New York State should honor those who have served this country by
providing them with the best opportunities in their civilian life, such
as assisting a veterans' goal to obtain a higher education.
