 Introduced  by  Sen.  GRIFFO -- read twice and ordered printed, and when
   printed to be committed to the Committee on Transportation
 
 AN ACT to amend the vehicle and traffic law, in relation to  restricting
   driving in a passing lane without overtaking or passing a vehicle
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. This act shall be known and may be cited as the "failure to
 pass act".
   § 2. Section 1122 of the vehicle and traffic law is amended by  adding
 a new subdivision (c) to read as follows:
   (C)  WHEN  DRIVING  ON  AN  INTERSTATE HIGHWAY, NO MOTOR VEHICLE SHALL
 DRIVE FOR MORE THAN ONE AND ONE-HALF MILES IN A  PASSING  LANE  IF  SUCH
 VEHICLE IS NOT OVERTAKING OR PASSING A VEHICLE PURSUANT TO THIS SECTION.
 NOTWITHSTANDING  15 NYCRR PART 131 OR ANY OTHER LAW, RULE, OR REGULATION
 TO THE CONTRARY, A VIOLATION OF THIS SUBDIVISION SHALL NOT CONSTITUTE  A
 LANE  VIOLATION  IN  ACCORDANCE  WITH  THE  REGULATORY  AUTHORITY OF THE
 COMMISSIONER. A VIOLATION OF THIS SUBDIVISION SHALL BE PUNISHABLE  BY  A
 FINE OF FIFTY DOLLARS FOR THE FIRST OFFENSE AND BY A FINE OF ONE HUNDRED
 DOLLARS FOR EACH SUBSEQUENT OFFENSE.
   § 3. This act shall take effect immediately.
