BILL NUMBER: S4782 SPONSOR: RIVERA TITLE OF BILL: An act to amend the public health law, in relation to modifying the definition of telehealth provider PURPOSE: Modifies the definition of telehealth provider. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends paragraph (z) of subdivision 2 of section 2999-cc of the public health law as it relates to telehealth providers. This section identifies a telehealth provider as a health care provider who possesses the requisite license, certification, registration, authori- zation, or credentialing to provide a health care service in New York state and reasonably determines that it is clinically appropriate to deliver such health care service via telehealth.

RIVERA, KRUEGER -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to modifying the definition of telehealth provider THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (z) of subdivision 2 of section 2999-cc of the public health law, as amended by section 1 of part V of chapter 57 of the laws of 2022, is amended to read as follows: (z) any [other provider as determined by the commissioner pursuant to regulation or, in consultation with the commissioner, by the commission- er of the office of mental health, the commissioner of the office of addiction services and supports, or the commissioner of the office for people with developmental disabilities pursuant to regulation] HEALTH CARE PROVIDER WHO: (I) POSSESSES THE REQUISITE LICENSE, CERTIFICATION, REGISTRATION, AUTHORIZATION OR CREDENTIALING TO PROVIDE A HEALTH CARE SERVICE IN NEW YORK STATE; AND (II) REASONABLY DETERMINES THAT IT IS CLINICALLY APPROPRIATE TO DELIV- ER SUCH HEALTH CARE SERVICE VIA TELEHEALTH. § 2.
