TITLE OF BILL:

An act to amend the public health law, in relation to modifying the
definition of telehealth provider

 
PURPOSE:

Modifies the definition of telehealth provider.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends paragraph (z) of subdivision 2 of section 2999-cc of
the public health law as it relates to telehealth providers. This
section identifies a telehealth provider as a health care provider who
possesses the requisite license, certification, registration, authori-
zation, or credentialing to provide a health care service in New York
state and reasonably determines that it is clinically appropriate to
deliver such health care service via telehealth.

Section 2 amends paragraph (y) of subdivision 2 of section 2999-cc of
the public health law as it relates to telehealth providers. This
section identifies a telehealth provider as a health care provider who
possesses the requisite license, certification, registration, authori-
zation, or credentialing to provide a health care service in New York
State and reasonably determines that it is clinically appropriate to
deliver such health care service via telehealth.

Section 3 provides the effective date.

 
JUSTIFICATION:

Accessing health care services via telehealth has proven to be critical
in ensuring the safety of residents for whom being in a health care
setting may expose them to disease, such as seniors, immunocompromised
individuals, and people with chronic conditions, as well as providing
patients with confidential and comprehensive health care from the safety
of their homes.

Even prior to the COVID-19 pandemic, it was clear that many parts of the
state lack access to basic healthcare services. In rural communities,
the issue is exacerbated by a lack of reliable and functional public
transportation. For the people living in these communities, telehealth
is an effective tool to ensure that they can access basic healthcare
services.

The COVID-19 Pandemic has underlined these shortcomings in our health-
care system. In the face of the pandemic, New Yorkers were asked to stay
home and follow strict social distancing guidelines; we asked employees
to work from home where possible; students were asked to transition to
online learning; and we have encouraged the expanded use of telehealth
for the delivery of healthcare services to meet these new realities.

Telehealth services have been essential during the course of the COVID-
19 pandemic, and it is only appropriate that the definition of a tele-
health provider be permanently expanded. This bill would codify the
current flexibility of telehealth providers established during the
COVID-19 State of Emergency to cover all bases of these providers in
perpetuity.

 AN ACT to amend the public health law,  in  relation  to  modifying  the
   definition of telehealth provider
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  Paragraph (z) of subdivision 2 of section 2999-cc  of  the
 public  health  law,  as amended by section 1 of part V of chapter 57 of
 the laws of 2022, is amended to read as follows:
   (z) any [other provider as determined by the commissioner pursuant  to
 regulation or, in consultation with the commissioner, by the commission-
 er  of  the  office  of mental health, the commissioner of the office of
 addiction services and supports, or the commissioner of the  office  for
 people  with  developmental  disabilities pursuant to regulation] HEALTH
 CARE PROVIDER WHO:
   (I) POSSESSES  THE  REQUISITE  LICENSE,  CERTIFICATION,  REGISTRATION,
 AUTHORIZATION  OR  CREDENTIALING TO PROVIDE A HEALTH CARE SERVICE IN NEW
 YORK STATE; AND
   (II) REASONABLY DETERMINES THAT IT IS CLINICALLY APPROPRIATE TO DELIV-
 ER SUCH HEALTH CARE SERVICE VIA TELEHEALTH.
   § 2. Paragraph (y) of subdivision 2 of section 2999-cc of  the  public
 health  law, as amended by section 3 of part F of chapter 57 of the laws
 of 2021, is amended to read as follows:
   (y) any [other provider as determined by the commissioner pursuant  to
 regulation or, in consultation with the commissioner, by the commission-
 er  of  the  office  of mental health, the commissioner of the office of
 addiction services and supports, or the commissioner of the  office  for
 people  with  developmental  disabilities pursuant to regulation] HEALTH
 CARE PROVIDER WHO:

 AUTHORIZATION  OR  CREDENTIALING TO PROVIDE A HEALTH CARE SERVICE IN NEW
 YORK STATE; AND
   (II) REASONABLY DETERMINES THAT IT IS CLINICALLY APPROPRIATE TO DELIV-
 ER SUCH HEALTH CARE SERVICE VIA TELEHEALTH.
   §  3.  This act shall take effect immediately, provided, however, that
 the amendments to paragraph (z) of subdivision 2 of section  2999-cc  of
 the  public  health law made by section one of this act shall be subject
 to the expiration and reversion of such paragraph pursuant to section  7
 of  part  V  chapter  57 of the laws of 2022, as amended, when upon such
 date the provisions of section two of this act shall take effect.
