BILL NUMBER: S4789 SPONSOR: RIVERA TITLE OF BILL: An act to amend the social services law, in relation to a specialized health home program to serve certain individuals with physical disabili- ties PURPOSE: Establishes a specialized health home program to serve certain individ- uals with physical disability. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends subdivision 5 of section 365-d of the social services law as it relates to establishing a specialized health home program. This section provides language including eligibility criteria for program participation, reimbursement rates, and the duties and responsi- bilities of the commissioner relating to the program.

RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to a specialized health home program to serve certain individuals with physical disa- bilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 365-l of the social services law is amended by adding a new subdivision 2-e to read as follows: 2-E. THE COMMISSIONER SHALL ESTABLISH A SPECIALIZED HEALTH HOME PROGRAM TO SERVE INDIVIDUALS WITH PHYSICAL DISABILITIES WHO ARE MEDICAID ELIGIBLE ADULTS EIGHTEEN YEARS OF AGE OR OLDER WITH A DIAGNOSIS OF A NEUROLOGICAL, MUSCULAR, OR NEUROMUSCULAR CONDITION, AND A MOBILITY IMPAIRMENT. A SPECIALIZED HEALTH HOME SHALL BE REIMBURSED ON A FEE-FOR- SERVICE BASIS AND SHALL RECEIVE ENHANCED RATES OF PAYMENT ESTABLISHED BY THE COMMISSIONER. THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO APPLY FOR FEDERAL WAIVERS OR STATE PLAN AMENDMENTS IF SUCH ACTION WOULD BE NECESSARY TO ASSIST IN PROMOTING THE OBJECTIVES OF THIS SUBDIVISION. SPECIALIZED HEALTH HOMES RECEIVING FUNDS UNDER THIS SUBDIVISION SHALL DOCUMENT AND DEMONSTRATE THE EFFECTIVE USE OF FUNDS DISTRIBUTED HEREIN. THE COMMISSIONER SHALL ESTABLISH STANDARDS FOR OPERATION OF A SPECIAL- IZED HEALTH HOME, INCLUDING REGULATIONS TO IMPLEMENT THIS SUBDIVISION. § 2. This act shall take effect on the ninetieth day after it shall have become a law. Effective immediately, the commissioner of health shall make regulations and take all actions reasonably necessary to implement this act on that date.
