BILL NUMBER: S5064 SPONSOR: CLEARE TITLE OF BILL: An act to amend the executive law, in relation to prohibiting the invol- untary use of sedatives during an arrest PURPOSE OR GENERAL IDEA OF BILL: To stop police from tranquilizing people so that they can be arrested and to avoid unnecessary deaths. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends clause (viii) of subparagraph 2 of paragraph (d) of subdivision 4 of section 840 of the executive law, to prohibit the administration of a sedative to a person being arrested without the consent of the person being arrested. Section 2. Sets an immediate effective date.

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the executive law, in relation to prohibiting the invol- untary use of sedatives during an arrest THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause (viii) of subparagraph 2 of paragraph (d) of subdi- vision 4 of section 840 of the executive law, as added by section 1 of part ZZ of chapter 55 of the laws of 2019, is amended to read as follows: (viii) prohibited uses of force, INCLUDING BUT NOT LIMITED TO, ADMIN- ISTERING OR DIRECTING THE ADMINISTRATION OF A SEDATIVE DURING THE ARREST OF AN INDIVIDUAL WITHOUT THE CONSENT OF SUCH INDIVIDUAL. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00002-01-3
