TITLE OF BILL:

An act to amend the state technology law, in relation to prohibiting the
use or access of the TikTok application on state issued electronic
devices

 
PURPOSE OR GENERAL IDEA OF BILL:

To reduce the potential security threats posed by the use of TikTok, a
Chinese-owned social media platform, on government devices.

 
SUMMARY OF PROVISIONS:

Section one of the bill amends the state technology law to prohibit
state employees from accessing TikTok on a government device.

Section two of the bill states the effective date.

JUSTIFICATION:

The social media platform TikTok extracts a vast amount of data from
over 135 million users in the United States. The data collected
includes, browsing data, keystrokes, and location information. For
years, the U.S. intelligence community has been concerned about how the
company collects data and whether the data could be used for espionage.

TikTok denies that it shares data with the Chinese government.  However,
the Chinese government could force TikTok, which is owned by the Chinese
company ByteDance, to share the data it collects on its users pursuant
to Chinese national security laws that require companies operating in
China to share their data with the government upon request.

The U.S. military and the states of Texas, Maryland, South Dakota, South
Carolina and Nebraska have all banned the app on government devices.

 AN ACT to amend the state technology law, in relation to prohibiting the
   use  or  access  of  the TikTok application on state issued electronic
   devices

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The state technology law is amended by adding a new section
 106-c to read as follows:
   §  106-C.  USE OF CERTAIN APPLICATIONS PROHIBITED. NO STATE AGENCY AND
 NO EMPLOYEE THEREOF SHALL DOWNLOAD OR  USE  THE  TIKTOK  APPLICATION  OR
 VISIT  THE TIKTOK WEBSITE ON GOVERNMENT-ISSUED DEVICES, INCLUDING STATE-
 ISSUED CELL PHONES, LAPTOPS, OR DEVICES CAPABLE OF INTERNET  CONNECTIVI-
 TY.  NO PERSON OR ENTITY WHO CONTRACTS WITH THE STATE OF NEW YORK OR ANY
 STATE AGENCY, BOARD, BUREAU, AUTHORITY, OR COMMISSION SHALL DOWNLOAD  OR
 USE  THE  TIKTOK APPLICATION OR VISIT THE TIKTOK WEBSITE ON STATE-ISSUED
 OR STATE-LEASED EQUIPMENT.
   § 2. This act shall take effect immediately.
