BILL NUMBER: S5133 SPONSOR: PERSAUD TITLE OF BILL: An act to amend the tax law and the state finance law, in relation to providing for taxpayer gifts for uterine fibroids education and estab- lishing the uterine fibroids education fund PURPOSE: Establishes non-exempt taxpayer-funded gifts toward the uterine fibroids education fund. Requires the commissioner to include space on the personal income tax return to enable a taxpayer to contribute to the fund. Appropriates all revenues received by the Dept. of Taxation and Finance to this fund along with grants, gifts and bequests to the fund. Designates the use of funds toward uterine fibroids education projects, which include grants to fund education programs that are approved by the DOH.

PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Budget and Revenue AN ACT to amend the tax law and the state finance law, in relation to providing for taxpayer gifts for uterine fibroids education and estab- lishing the uterine fibroids education fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The tax law is amended by adding a new section 209-Q to read as follows: § 209-Q. GIFT FOR UTERINE FIBROIDS EDUCATION. A TAXPAYER IN ANY TAXA- BLE YEAR MAY ELECT TO CONTRIBUTE TO THE SUPPORT OF THE UTERINE FIBROIDS EDUCATION FUND. SUCH CONTRIBUTION SHALL BE IN ANY WHOLE DOLLAR AMOUNT AND SHALL NOT REDUCE THE AMOUNT OF THE STATE TAX OWED BY SUCH TAXPAYER. THE COMMISSIONER SHALL INCLUDE SPACE ON THE CORPORATE INCOME TAX RETURN TO ENABLE A TAXPAYER TO MAKE SUCH CONTRIBUTION. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ALL REVENUES COLLECTED PURSUANT TO THIS SECTION SHALL BE CREDITED TO THE UTERINE FIBROIDS EDUCATION FUND AND SHALL BE USED ONLY FOR THOSE PURPOSES ENUMERATED IN SECTION NINETY-SEVEN-BBBBB OF THE STATE FINANCE LAW. § 2. Part 2 of article 22 of the tax law is amended by adding a new section 630-l to read as follows: § 630-L. GIFT FOR UTERINE FIBROIDS EDUCATION. AN INDIVIDUAL IN ANY TAXABLE YEAR MAY ELECT TO CONTRIBUTE TO THE UTERINE FIBROIDS EDUCATION FUND. SUCH CONTRIBUTION SHALL BE IN ANY WHOLE DOLLAR AMOUNT AND SHALL NOT REDUCE THE AMOUNT OF STATE TAX OWED BY SUCH INDIVIDUAL.
