BILL NUMBER: S5250 SPONSOR: WEIK TITLE OF BILL: An act in relation to authorizing the Good Samaritan Hospital Medical Center to file an application for a real property tax exemption PURPOSE: The Good Samaritan Hospital Medical Center acquired real property located at 1111 Montauk Highway in the town of Islip, Suffolk County after the exemption application status deadline. This bill, if enacted, would permit the not-forprofit medical center to receive a retroactive real property tax exemption on this newly acquired parcel. (Section 474.01, Block 03.00, Lot 005.00) SUMMARY OF PROVISIONS: Section 1: Authorizes the Islip town assessor to accept an, application for a retroactive real property tax exemption from the Good Samaritan Hospital Medical Center for the 2021-2022 assessment roll.

WEIK -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing the Good Samaritan Hospital Medical Center to file an application for a real property tax exemption THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the town of Islip, county of Suffolk, is hereby author- ized to accept an application for exemption from real property taxes from the Good Samaritan Hospital Medical Center pursuant to section 420-a of the real property tax law with respect to the 2021-2022 assess- ment roll, for the parcel located at 1111 Montauk Highway in the town of Islip, county of Suffolk, otherwise known as Suffolk county tax map district 0500, section 474.01, block 03.00, lot 005.00. If accepted, the application shall be reviewed as if it had been received on or before the taxable status dates established for such roll. If satisfied that such not-for-profit organization would otherwise be entitled to such exemption if such not-for-profit organization has acquired the subject property and filed an application for exemption by the appropriate taxable status date, the assessor, upon approval by the town board of Islip, may grant exemption from all taxation and make appropriate corrections to the subject roll. If such exemption is grant- ed and such not-for-profit organization therefore shall have paid any tax with respect to the subject roll, the governing body or tax depart- ment may, in its sole discretion, provide for the refund of those taxes paid and cancel any taxes, fines, penalties, interest, or tax liens remaining unpaid. § 2. This bill, if enacted, would allow for the medical center to receive a retroactive real property tax exemption on this newly acquired parcel. Notwithstanding any other provision of law to the contrary, the assessor of the town of Islip, county of Suffolk, is hereby author- ized to accept from the Good Samaritan Hospital Medical Center, an application for exemption from real property taxes pursuant to section 420-a of the real property tax law with respect to the 2019-2020 assess- ment roll, for the parcel owned by such organization, with such parcel being located at 1111 Montauk Highway, in the hamlet of West Islip, town of Islip, county of Suffolk, otherwise known as Suffolk county tax map number 474.1-2-1. If accepted, the application shall be reviewed as if it had been received on or before the taxable status date established for such roll. If satisfied that such non-profit organization would otherwise be entitled to such exemption if such organization had filed an application for exemption by the appropriate taxable status date, the assessor, upon approval by the town board of Islip, may grant exemption from all taxa- tion and make appropriate corrections to the subject roll. If such exemption is granted and such organization therefore shall have paid any tax with respect to the subject roll, the applicable governing body or tax department may, in its sole discretion, provide for the refund of the taxes paid, along with any fines or penalties paid, and cancel any taxes, fines, penalties, interest, or tax liens remaining unpaid. § 2. The proposed bill authorizing Good Samaritan Hospital Medical Center to apply for exemption from property taxes on 1111 Montauk Highway will impose an additional financial burden on your constituents in West Islip if passed. The Hospital already has a tax exempt status on a number of properties it owns in West Islip however this case would extend that privilege to office condominium space in a building occupied by other medical practices. We believe this will unfairly add another burden to West Islip taxpayers who must pay for the shortfall in taxes created by these exemptions. There is no need for additional legislation creating another catagory of tax exempt status and there is no benefit to residents. in fact, it will harm residents, especially if it grants retroactive exemption requiring the refund of taxes already paid and distributed to schools and agencies as required. There is a point where this becomes corporate greed which is clearly harmfull to the people you represent. Please withdraw your support of this bill. John Davis, President Willetts Point Association
Good Samaritan Hospital owns many properties in West Islip causing an unnecessary burden on residents. There does not need to be special legislation extended to this already Tax Exempt facility. The bldg in question seems to be a condo/office facility which in the past was taxed as such. Removing condos by special legislation to tax exempt status will have a negative impact on your constituents, who are the very ones you represent. Please reconsider your support of this bill.
