BILL NUMBER: S5449 SPONSOR: JACKSON TITLE OF BILL: An act to amend the education law, in relation to requiring public schools to start no earlier than eight thirty a.m. PURPOSE: The purpose of this bill is to prohibit the start time of public schools before 8:30AM across the State. SUMMARY OF PROVISIONS: Section 1 creates a new subdivision 60 of Section 305 of the Education Law that requires the Commissioner of Education to promulgate rules and regulations requiring public schools to start no earlier than 8:30AM. Section 2 creates a new subdivision 8-a of Section 3604 of the Education Law that requires trustees or boards of education to provide a report for the preceding school year demonstrating that public schools started

JACKSON, SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring public schools to start no earlier than eight thirty a.m. THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 60 to read as follows: 60. THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS REQUIRING ALL PUBLIC SCHOOLS WITHIN THE STATE TO START NO EARLIER THAN EIGHT THIR- TY A.M. § 2. Section 3604 of the education law is amended by adding a new subdivision 8-a to read as follows: 8-A. NO PUBLIC SCHOOL WITHIN THE STATE SHALL BE ENTITLED TO ANY PORTION OF SUCH SCHOOL MONEYS ON SUCH APPORTIONMENT UNLESS THE REPORT OF THE TRUSTEES OR BOARD OF EDUCATION FOR THE PRECEDING SCHOOL YEAR SHALL SHOW THAT THE PUBLIC SCHOOLS STARTED NO EARLIER THAN EIGHT THIRTY A.M. § 3. This act shall take effect immediately and shall apply to all academic years beginning on and after such date.
