TITLE OF BILL:

An act to amend the administrative code of the city of New York, in
relation to certain promotions to lieutenant or sergeant in the detec-
tive bureau in the city of New York

 
PURPOSE:

To provide that Police Sergeants and Lieutenants assigned to the Detec-
tive Bureau and while designated as Commanders of Detective Squad be
granted the titles of Sergeant Commander or Lieutenant of a Detective
Squad after a certain period in that assignment.

 
SUMMARY OF PROVISIONS:

Amends subdivision c of section 14-103 of the administrative code of the
City of New York to require that any permanently appointed lieutenant or
sergeant who is temporarily assigned to perform the duties of a comman-
der or a supervisor of a detective squad shall be permanently appointed

as a lieutenant commander or sergeant commander of a detective squad
once such temporary assignments exceeds 18 months and shall be paid the
ordinary compensation for such rank.

 
EXISTING LAW:

Chapter 755 of the laws of 1990 required the Police Commission to estab-
lish the current Detectives Bureau and set certain staffing requirements
including the temporary detailing of police officers, Sergeants and
Lieutenants to the bureau. Whenever police officers serving in such
temporary position exceeds eighteen months, they are required to be
appointed as a detective and receive the compensation ordinarily paid to
a detective performing such duties. Sergeants and Lieutenants serving in
temporary assignments as lieutenant commanders or sergeant supervisors
in the detective squad are not afforded this benefit.

 
JUSTIFICATION:

Police Lieutenants and Sergeants assigned to an investigatory position
accepts the added responsibilities of giving direction to the highest
level of cases in the most sensitive areas of law enforcement. These
would include narcotics, organized crime, intelligence, undercover
assignments and all detective investigations.

While under special assignment lieutenants and sergeants, who were
supposed to be on this assignment for 18 months or less, often could not
be released back to uniformed detail due to ongoing court cases or
lengthy investigations. Therefore, the lieutenants and sergeants were
performing these duties without the salary associated with the perform-
ance of such duties.

Additionally this legislation would provide equity for all ranks that
are assigned to the Detective Bureau in excess of 18 months,

 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation to certain promotions to lieutenant or sergeant in the detec-
   tive bureau in the city of New York

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  Subdivision c of section 14-103 of the administrative code
 of the city of New York, as amended by chapter 755 of the laws of  1990,
 is amended to read as follows:
   c.  The commissioner may designate lieutenants as commanders of detec-
 tive squads, and sergeants as supervisors of detective squads, who while
 performing duty in such bureau and while so designated as commanders  of
 detective  squads  or supervisors of detective squads shall be paid such
 salary as may be determined by the mayor. ANY PERSON  WHO  HAS  RECEIVED
 PERMANENT  APPOINTMENT  AS  A  LIEUTENANT OR SERGEANT AND IS TEMPORARILY
 ASSIGNED TO PERFORM THE DUTIES OF A COMMANDER OF A  DETECTIVE  SQUAD  OR
 SUPERVISOR  OF A DETECTIVE SQUAD SHALL, WHENEVER SUCH ASSIGNMENT EXCEEDS
 EIGHTEEN MONTHS IN DURATION, BE APPOINTED AS A LIEUTENANT COMMANDER OF A
 DETECTIVE SQUAD OR SERGEANT SUPERVISOR OF A DETECTIVE SQUAD AND  RECEIVE
 THE COMPENSATION ORDINARILY PAID TO PERFORM SUCH DUTIES.
   § 2. This act shall take effect immediately.
