BILL NUMBER: S5766 SPONSOR: PARKER TITLE OF BILL: An act to amend the environmental conservation law, in relation to the definition of eligible vehicles for climate smart community projects PURPOSE OR GENERAL IDEA OF BILL: This legislation would remove the restrictive definition that electric vehicles are only eligible for ,climate smart community projects if they have four wheels. This amendment would allow for two, three, and four wheeled vehicles to access funding in an effort to broadly reduce green- house gas emissions. SUMMARY OF PROVISIONS: Section 1: Subparagraph (i) of paragraph c of subdivision 1 of section 54-1521 of the environmental conservation law, as amended by section 1 of part CCC of chapter 55 of the laws of 2021, is amended.

PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the definition of eligible vehicles for climate smart community projects THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (i) of paragraph c of subdivision 1 of section 54-1521 of the environmental conservation law, as amended by section 1 of part CCC of chapter 55 of the laws of 2021, is amended to read as follows: (i) has UP TO four wheels; § 2. Paragraph b of subdivision 3 of section 54-1521 of the environ- mental conservation law, as added by section 1 of part CCC of chapter 55 of the laws of 2021, is amended to read as follows b. The department, in consultation with the New York state energy research and development authority, shall determine the amount of the rebate taking into consideration the electric range of the vehicle AND THE ESTIMATED ANNUAL GREENHOUSE GAS EMISSIONS REDUCTIONS PROVIDED BY THAT VEHICLE AS COMPARED TO A SIMILAR INTERNAL COMBUSTION ENGINE VEHICLE, provided that a rebate of an eligible purchase shall be not less than two thousand five hundred dollars per vehicle and not more than [seven] FIVE thousand [five hundred] dollars per vehicle. § 3.
