BILL NUMBER: S5893 SPONSOR: BAILEY TITLE OF BILL: An act to amend the public health law, in relation to instituting a moratorium on the closure of hospitals during a pandemic PURPOSE OR GENERAL IDEA: The purpose of this bill is to ensure that hospitals within the state of New York remain open during a duly declared pandemic. SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill adds a new section to the public health law requiring the state to institute a moratorium on hospital closures once a state of emergency has been declared due to a pandemic. The law would prevent hospitals from closing or otherwise reducing their capacity below the hospital's normal capacity as of the date the moratorium was imposed.

BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to instituting a moratorium on the closure of hospitals during a pandemic THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2831 to read as follows: § 2831. HOSPITAL CLOSURE MORATORIUM DURING PANDEMICS. NOTWITHSTANDING ANY PROVISIONS OF LAW, RULE OR REGULATION TO THE CONTRARY, THE STATE SHALL INSTITUTE A MORATORIUM ON THE CLOSURE OF HOSPITALS DURING ANY STATE OF EMERGENCY DECLARED DUE TO A PANDEMIC. DURING SUCH MORATORIUM, NO HOSPITAL SHALL CLOSE OR REDUCE CAPACITY BELOW THE HOSPITAL'S CAPACITY AS OF THE DATE THE MORATORIUM WAS IMPOSED. § 2. This act shall take effect immediately.
