BILL NUMBER: S5981 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the cannabis law, in relation to requiring all edible cannabis products be packaged in child resistant packaging PURPOSE: To package edible cannabis products in child resistant packaging to prevent children from consuming edible cannabis. SUMMARY OF PROVISIONS: Section 1. Section 125 of the cannabis law is amended by adding a new subdivision 13 to read as follows: 13. (a) No registered organization, licensee, or permittee or other entity under the jurisdiction of the board shall sell, or agree to sell or deliver in this state any edible cannabis product that is not in child resistant packaging. (b) For the purposes of this subdivision, "edible cannabis product"

SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the cannabis law, in relation to requiring all edible cannabis products be packaged in child resistant packaging THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 125 of the cannabis law is amended by adding a new subdivision 13 to read as follows: 13. (A) NO REGISTERED ORGANIZATION, LICENSEE, OR PERMITTEE OR OTHER ENTITY UNDER THE JURISDICTION OF THE BOARD SHALL SELL, OR AGREE TO SELL OR DELIVER IN THIS STATE ANY EDIBLE CANNABIS PRODUCT THAT IS NOT IN CHILD RESISTANT PACKAGING. (B) FOR THE PURPOSES OF THIS SUBDIVISION, "EDIBLE CANNABIS PRODUCT" SHALL MEAN A "CANNABIS-INFUSED PRODUCT" AS DEFINED IN SUBDIVISION TEN OF SECTION THREE OF THIS CHAPTER THAT IS INTENDED FOR CONSUMPTION. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
