BILL NUMBER: S5987 SPONSOR: MATTERA TITLE OF BILL: An act to amend the penal law, in relation to exempting retired peace officers from the crime of criminal possession of a firearm, rifle or shotgun in a sensitive location PURPOSE: To add retired peace officers to the exempt list of those who can continue to carry their legal firearms in sensitive locations. SUMMARY: Section 1 subdivision 3 of section 265.01-e of penal law is amended to add new paragraph (d-1) to read as followed: persons who were employed as a peace officers as designated by section 2.10 of the criminal proce- dure law but are retired.

MATTERA -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to exempting retired peace officers from the crime of criminal possession of a firearm, rifle or shotgun in a sensitive location THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 265.01-e of the penal law is amended by adding a new paragraph (d-1) to read as follows: (D-1) PERSONS WHO WERE EMPLOYED AS PEACE OFFICERS AS DESIGNATED BY SECTION 2.10 OF THE CRIMINAL PROCEDURE LAW BUT ARE RETIRED; § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10485-01-3
