TITLE OF BILL:

An act to amend the public health law, in relation to children's non-re-
gulated camps

 
PURPOSE:

To require single-purpose day camps and camps regulated by DOH to check
the DOJ national sex offender database for all potential employees and
volunteers.

 
SUMMARY OF PROVISIONS:

Section one amends the public health law by adding a new section 1394-c,
requiring the operators of children's non-regulated camps to ascertain
whether an employee or volunteer is listed on the national sex offender
registry using the DOJ public database prior to the date an employee or
volunteer begins work at such camp.

Sections three, four, and five amend sections 1392a, 1394a, and 1394b to
require camps regulated by DOH to check whether an employee or volunteer
is listed on the national sex offender registry using the DOJ public
database prior to the date the employee or volunteer begins work at a
camp.

Section six states the effective date.

 
JUSTIFICATION:

Chapter 248 of the Laws of 2022 established additional background check
requirements for camps. The law created a requirement for both DOH regu-
lated and single-purpose camps to run all employees and volunteers
through the national sex offender registry using the National Crime
Information Center (NCIC) database.

However, in New York, only law enforcement and DCJS may access this
information through NCIC. This legislation amends Chapter 248 of 2022 to
instead require camps to conduct a national sex offender registry search
through the DOJ public database. DOH regulated camps already use this
database. This chapter amendment is necessary to ensure that the
original intent of the law is preserved and that camps use a system that
is accessible to them to conduct background checks.

 AN ACT to amend the public health law, in relation to children's non-re-
   gulated camps
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. Section 1394-d of the public health law, as added by chap-
 ter 248 of the laws of 2022, is amended to read as follows:
   § 1394-d. Requirement to check sex offender  registry.  Every  person,
 firm, limited liability company, association and corporation which oper-
 ates a children's non-regulated camp as defined in section three hundred
 ninety-eight-f  of  the general business law shall be required to ascer-
 tain whether an employee or volunteer is listed on the state sex  offen-
 der  registry  pursuant  to  article six-C of the correction law and the
 national sex offender registry using  the  [national  crime  information
 center, established under the Adam Walsh child protection and safety act
 of  2006  (42 U.S.C. 16901 et seq.)] UNITED STATES DEPARTMENT OF JUSTICE
 NATIONAL SEX OFFENDER PUBLIC WEBSITE prior to the day such  employee  or
 volunteer  commences  work at such camp and annually thereafter prior to
 their arrival at such camp.
   § 2. Section 1392-a of the public health law, as  amended  by  chapter
 248 of the laws of 2022, is amended to read as follows:
   §  1392-a.  Requirement  to check sex offender registry. Every person,
 firm, limited liability company, association and corporation which oper-
 ates a children's overnight camp shall be required, to ascertain whether
 an employee or volunteer is listed on the state  sex  offender  registry
 pursuant  to  article  six-C  of the correction law and the national sex
 offender registry using the [national crime information  center,  estab-
 lished  under the Adam Walsh child protection and safety act of 2006 (42
 U.S.C. 16901 et seq.)] UNITED STATES DEPARTMENT OF JUSTICE NATIONAL  SEX
 OFFENDER  PUBLIC  WEBSITE  prior  to  the day such employee or volunteer

 offender registry using the [national crime information  center,  estab-
 lished  under the Adam Walsh child protection and safety act of 2006 (42
 U.S.C. 16901 et seq.)] UNITED STATES DEPARTMENT OF JUSTICE NATIONAL  SEX
 OFFENDER  PUBLIC  WEBSITE  prior  to  the day such employee or volunteer
 commences work at said camp  and  annually  thereafter  prior  to  their
 arrival at said camp.
   §  4.  Section  1394-b of the public health law, as amended by chapter
 248 of the laws of 2022, is amended to read as follows:
   § 1394-b. Requirement to check sex offender  registry.  Every  person,
 firm, limited liability company, association and corporation which oper-
 ates a traveling summer day camp shall be required, to ascertain whether
 an  employee  or  volunteer is listed on the state sex offender registry
 pursuant to article six-C of the correction law  and  the  national  sex
 offender  registry  using the [national crime information center, estab-
 lished under the Adam Walsh child protection and safety act of 2006  (42
 U.S.C.  16901 et seq.)] UNITED STATES DEPARTMENT OF JUSTICE NATIONAL SEX
 OFFENDER PUBLIC WEBSITE prior to the  day  such  employee  or  volunteer
 commences  work  at  said  camp  and  annually thereafter prior to their
 arrival at said camp.
   § 5. This act shall take effect immediately.
