 AN ACT relating to waiving the local residency  requirement  for  public
   employees in the village of Portville

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The village of Portville, county of Cattaraugus, adopted  a
 resolution  providing for the waiving of the local residency requirement
 for public employees to include not only the county of Cattaraugus,  but
 to  include  all  counties in the state of New York. Notwithstanding any
 other provision of law to the contrary, the village of Portville, county
 of Cattaraugus shall not require public employees to reside in the coun-
 ty of Cattaraugus as a condition of employment, and shall permit  public
 employees to reside within any county in the state of New York.
   § 2. This act shall take effect immediately.

 AN ACT to amend the public officers law,  in  relation  to  waiving  the

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 3 of the public officers law is amended by adding
 a new subdivision 73 to read as follows:
   73. IN THE VILLAGE OF PORTVILLE, IN THE  COUNTY  OF  CATTARAUGUS,  THE
 PROVISIONS  OF  THIS  SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE
 POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE
 OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE
 REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING PUBLIC
 OFFICE OF THE VILLAGE OF PORTVILLE, PROVIDED THAT SUCH PERSON RESIDES IN
 THE STATE OF NEW YORK. PROVIDED, HOWEVER,  THAT  ANY  PERSON  PERFORMING
 SUCH  FUNCTIONS  OR  HOLDING SUCH OFFICES IN ANY OTHER COUNTY SHALL BE A
 RESIDENT OF SUCH COUNTY UNLESS OTHERWISE PROVIDED BY LAW.
   § 2. This act shall take effect immediately.

   to  waiving  the local residency requirement for the village clerk and
   village treasurer in the village of Portville
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 3 of the public officers law is amended by adding a
 new subdivision 75 to read as follows:
   75.  IN  THE  VILLAGE  OF PORTVILLE, IN THE COUNTY OF CATTARAUGUS, THE
 PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A  RESIDENT  OF  THE

 TY  OR  AN  ADJOINING  COUNTY  WITHIN THE STATE OF NEW YORK.   PROVIDED,
