BILL NUMBER: S6333 SPONSOR: BROUK TITLE OF BILL: An act to amend the general municipal law and the public officers law, in relation to childcare and dependent care reimbursement for volunteer members of public bodies PURPOSE OR GENERAL IDEA OF BILL: This bill would allow volunteer members serving on public bodies to be reimbursed for childcare and dependent care expenses incurred during the performance of their official duties serving on a public body. SUMMARY OF PROVISIONS: Section one of this bill amends the General Municipal Law to allow volunteer members serving on public bodies to be reimbursed for child- care and dependent care expenses incurred during the performance of their official duties serving on a public body.

BROUK -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law and the public officers law, in relation to childcare and dependent care reimbursement for volun- teer members of public bodies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 72-s to read as follows: § 72-S. CHILDCARE AND DEPENDENT CARE REIMBURSEMENT FOR VOLUNTEER MEMBERS OF PUBLIC BODIES. 1. FOR PURPOSES OF THIS SECTION, "PUBLIC BODY" SHALL HAVE THE SAME MEANING AS SUCH TERM IS DEFINED IN SECTION ONE HUNDRED TWO OF THE PUBLIC OFFICERS LAW. 2. VOLUNTEER MEMBERS OF A PUBLIC BODY SHALL BE REIMBURSED FOR ACTUAL CHILDCARE AND DEPENDENT CARE EXPENSES INCURRED DURING THE PERFORMANCE OF HIS, HER, OR THEIR DUTIES SERVING ON SUCH PUBLIC BODY, INCLUDING BUT NOT LIMITED TO TIME SPENT ATTENDING REGULAR OR SPECIAL MEETINGS OF SUCH PUBLIC BODY. 3. UPON THE DISCHARGE OF HIS, HER, OR THEIR OFFICIAL DUTIES, IF APPLI- CABLE, A VOLUNTEER MEMBER OF A PUBLIC BODY SHALL SUBMIT DOCUMENTATION OF THE COSTS OF CHILDCARE OR DEPENDENT CARE EXPENSES INCURRED DURING THE PERFORMANCE OF THEIR DUTIES TO THE APPROPRIATE PUBLIC OFFICER OR OTHER PERSON DESIGNATED TO RECEIVE DOCUMENTATION FOR FINANCIAL REIMBURSEMENT OR THE MUNICIPALITY OR POLITICAL SUBDIVISION WHICH OVERSEES SUCH PUBLIC BODY OR APPOINTS ITS MEMBERS. § 2. Section 64 of the public officers law is amended to read as follows: § 64. Payment of expenses of public officers. Every public officer who is not allowed any compensation for his, HER OR THEIR services shall be paid his, HER OR THEIR actual expenses necessarily incurred in the discharge of his, HER OR THEIR official duties, INCLUDING CHILDCARE AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
