BILL NUMBER: S6415 SPONSOR: COMRIE TITLE OF BILL: An act to amend the real property actions and proceedings law and the New York city civil court act, in relation to the establishment of an escrow account PURPOSE: This bill creates a court ordered escrow account to ensure tenants continue paying rent while undergoing any court related proceedings relative to their dwelling as such proceedings are being resolved in court. SUMMARY OF PROVISIONS: Section 1 adds subdivision 3 to section 701 of the real property and proceedings law (RPAPL) requires tenants make payments to court escrow account in order to appear in court relative to recover possession of real property.

COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the real property actions and proceedings law and the New York city civil court act, in relation to the establishment of an escrow account THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 701 of the real property actions and proceedings law is amended by adding a new subdivision 3 to read as follows: 3. ANY COURT WHICH HOLDS A SPECIAL PROCEEDING TO RECOVER REAL PROPERTY SHALL ESTABLISH AN ESCROW ACCOUNT. IN ORDER TO APPEAR IN ANY SUCH COURT, A TENANT SHALL SUBMIT ANY OWED RENT INTO SUCH ESCROW ACCOUNT. § 2. Section 769 of the real property actions and proceedings law is amended by adding a new subdivision 3 to read as follows: 3. EACH COURT WHICH HOLDS SPECIAL PROCEEDINGS PURSUANT TO SUBDIVISION ONE OF THIS SECTION SHALL ESTABLISH AN ESCROW ACCOUNT. IN ORDER TO APPEAR IN SUCH COURT, A TENANT SHALL SUBMIT ANY OWED RENT INTO SUCH ESCROW ACCOUNT. § 3. Section 791 of the real property actions and proceedings law is amended by adding a new subdivision 3 to read as follows: 3.
