TITLE OF BILL:

An act in relation to authorizing the city of Rochester to convey by
appropriate instruments to the Rochester Pure Waters District, an ease-
ment in Genesee Valley Park, for installation and maintenance of sani-
tary sewer facilities

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 authorizes the City of Rochester to grant the Rochester Pure
Waters District an easement in Genesee Valley Park described in section
three, to construct, operate, repair, replace, and maintain sanitary
sewer facilities.

Section 2 provides that alienation authorization shall be effective only
if the city of Rochester dedicate an amount equal to or greater than the
fair market value of the easement interest being alienated to the acqui-
sition of new parklands and/or capital improvements to existing park and
recreational facilities

Section 3 includes the description of the easement.

Section 4 provides the transfer of easement shall not occur until the
city of Rochester has complied with any federal requirements pertaining
to the alienation or conversion of parklands.

Section 5 provides the effective date.

 
JUSTIFICATION:

Genesee Valley Park (GVP) is located on the east and west banks of the
Genesee River (River) in the City of Rochester (City). The City owns all
of GVP. The City maintains and operates those portions of the GVP west
of the River. By virtue of long standing agreements, Monroe County main-
tains and operates GVP premises east of the River. The University of
Rochester borders GVP on its east side.

The Wilson Boulevard Trunk System (WBTS) was originally a New York State
sewer installed in the 1920's along the east bank of the Genesee River
in the City of Rochester. The Pure Waters Division of the Monroe County
Department of Environmental Services (MCDES) now operates the WBTS as
part of the Rochester Pure Waters District.

The WBTS serves the University of Rochester, including Strong Memorial
Hospital, as well as other businesses and residences located east of the
Genesee River. The WBTS does not have sufficient capacity to accommodate
additional growth. Without expansion of the WBTS, critical local
projects, such as Strong Memorial Hospital's Expansion Project, cannot
proceed, thus limiting the expansion of healthcare access to the Roches-
ter community.

The only solution to relieve the WBTS system is to connect it to an
existing MCDES sewer located on the west side of the River that has
capacity. The sanitary sewer facilities that will be constructed in a
0.92 acre easement described in the bill that will extend approximately
1,490 linear feet from the east side of GVP, under the River, and
through the west side of GVP to the existing sewer main.  The sanitary
sewer facilities will be located entirely underground and constructed
using directional drilling to minimize any potential impact to GVP.

The $641 million Strong Expansion Project is the University's largest
project and one of the largest projects in the region's history. The
expansion will create a new Emergency Department approximately three
times the size of the existing space, provide private single patient
rooms, expand diagnostic and treatment spaces, improve mental and behav-
ioral health care, and enlarge the Greater Rochester's only Level-1
trauma facility to provide the most advanced care to the most complex
traumatic injuries. The expansion will also enlarge the Pediatric ED for
Golisano Children's Hospital, the region's only children's hospital. It
will help address chronic bed shortages and ED overcrowding issues that
the community has faced for years, as well as increase the availability
of high-quality mental health and addiction services.

As consideration for the easement described in the bill, the University
of Rochester will grant to the city of Rochester a conservation easement
over a parcel of 3.962 acres of land adjacent to Genesee Valley Park and
shall further compensate the city of Rochester in a sum of not less than
$100,000, which sum shall constitute an amount equal to or greater than
the fair market value of the easement interest being alienated. Such sum
shall be used for the acquisition of new parklands and/or capital
improvements to existing park and recreational facilities.

Construction of a major hospital facility cannot proceed without the
easement proposed in this bill.

 AN ACT in relation to authorizing the city of  Rochester  to  convey  by
   appropriate  instruments  to  the  Rochester  Pure Waters District, an

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The city of Rochester, acting by and through its  governing
 body,  is  hereby authorized to convey by appropriate instruments to the
 Rochester Pure Waters District, a permanent easement in  Genesee  Valley
 Park described in section three of this act, for the purpose of enabling
 such water district to construct, operate, repair, replace, and maintain
 sanitary   sewer   facilities.   Upon   completion  of  any  repairs  or
 construction, the Rochester  Pure  Waters  District  shall  restore  the
 surface  of  the  lands and the lands shall continue to be used for park
 purposes.
   § 2. The authorization provided in section one of this  act  shall  be
 effective  only  upon  the  condition  that  the University of Rochester
 grants to the city of Rochester a conservation  easement  over  a  3.962
 acre  parcel  of  land  adjacent  to  Genesee  Valley Park, and that the
 University of Rochester further compensate the city of  Rochester  in  a
 sum  of not less than $100,000 or an amount equal to or greater than the
 fair market value of the easement interest being alienated  pursuant  to
 section one of this act, whichever is greater, to be used for the acqui-
 sition of new parklands and/or capital improvements to existing park and
 recreational facilities.
   § 3. The easements to be conveyed by the city of Rochester pursuant to
 the provisions of this act are described as follows:

   All that track or parcel of land being in the City of Rochester, Coun-
 ty  of  Monroe,  State of New York, as shown on the accompanying map and

 alienation  or  conversion complies with all conditions which the secre-
 tary of the interior deems necessary to assure that the substitution  of
 other  lands be equivalent in fair market value and recreational useful-
 ness to the lands being alienated or converted.
   § 5. This act shall take effect immediately.

   § 4. The conveyance of the easement authorized by  the  provisions  of
 this  act  shall not occur until the city of Rochester has complied with
 any federal requirements pertaining to the alienation or  conversion  of
 parklands,  including  satisfying the secretary of the interior that the
 alienation or conversion complies with all conditions which  the  secre-
 tary  of the interior deems necessary to assure that the substitution of
 other lands be equivalent in fair market value and recreational  useful-
 ness to the lands being alienated or converted.
   § 5. This act shall take effect immediately.
