BILL NUMBER: S6613 SPONSOR: FERNANDEZ TITLE OF BILL: An act to amend the education law, in relation to authorizing schools to possess and administer FDA approved opioid reversal agents in emergency situations PURPOSE OR GENERAL IDEA OF BILL: This bill is intended to protect the health and safety of students, faculty, and family members at various school functions by requiring school facilities to have opioid reversal agents on premises for use during emergencies. SUMMARY OF PROVISIONS: The education law is amended by adding a new section 921-b to read as described on the bill.

FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to authorizing schools to possess and administer FDA approved opioid reversal agents in emergen- cy situations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 921-b to read as follows: § 921-B. ON-SITE FDA APPROVED OPIOID REVERSAL AGENTS. 1. SCHOOL DISTRICTS, BOARDS OF COOPERATIVE EDUCATIONAL SERVICES, COUNTY VOCATIONAL EDUCATION AND EXTENSION BOARDS, CHARTER SCHOOLS, AND NON-PUBLIC ELEMEN- TARY AND SECONDARY SCHOOLS IN THIS STATE MAY PROVIDE AND MAINTAIN ON-SITE IN EACH INSTRUCTIONAL SCHOOL FACILITY ALL FDA APPROVED OPIOID REVERSAL AGENTS IN QUANTITIES AND TYPES DEEMED BY THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH, TO BE ADEQUATE TO ENSURE READY AND APPROPRIATE ACCESS FOR USE DURING EMERGENCIES TO ANY STUDENT OR STAFF TO NEGATE OR NEUTRALIZE, IN WHOLE OR IN PART, THE PHARMACOLOGI- CAL EFFECTS OF AN OPIOID IN THE HUMAN BODY. 2. SCHOOL DISTRICTS, BOARDS OF COOPERATIVE EDUCATIONAL SERVICES, COUN- TY VOCATIONAL EDUCATION AND EXTENSION BOARDS, CHARTER SCHOOLS, AND NON- PUBLIC ELEMENTARY AND SECONDARY SCHOOLS IN THIS STATE, ANY PERSON EMPLOYED BY ANY SUCH ENTITY, OR EMPLOYED BY A CONTRACTOR OF SUCH AN ENTITY WHILE PERFORMING SERVICES FOR THE ENTITY MAY ADMINISTER ANY FDA APPROVED OPIOID REVERSAL AGENTS IN THE EVENT OF AN EMERGENCY. § 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
