BILL NUMBER: S6614 SPONSOR: BORRELLO TITLE OF BILL: An act to amend the labor law, in relation to contractors building new one-family residential construction PURPOSE OR GENERAL IDEA OF BILL: To amend the Labor Law, in order to exempt contractors building new one-family residential construction from the requirements of Sections 240 and 241 (Scaffold Act). This measure will reduce the financial burdens placed on residential builders by Scaffold Act provisions and, thereby, facilitate less costly new home construction in New York State. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends the opening paragraph of Subdivision 1 of Section 240 of the Labor Law to exempt contractors building new one-family residen- tial construction from the strict liability standards governing the erection of scaffolding and other devices by contractors engaged in

BORRELLO -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to contractors building new one-family residential construction THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of subdivision 1 of section 240 of the labor law, as amended by chapter 241 of the laws of 1981, is amended to read as follows: All contractors and owners and their agents, except owners of one and two-family dwellings who contract for but do not direct or control the work AND CONTRACTORS BUILDING NEW ONE-FAMILY RESIDENTIAL CONSTRUCTION, in the erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure shall furnish or erect, or cause to be furnished or erected for the performance of such labor, scaffolding, hoists, stays, ladders, slings, hangers, blocks, pulleys, braces, irons, ropes, and other devices which shall be so constructed, placed and oper- ated as to give proper protection to a person so employed. § 2. The opening paragraph of section 241 of the labor law, as amended by chapter 670 of the laws of 1980, is amended to read as follows: All contractors and owners and their agents, except owners of one and two-family dwellings who contract for but do not direct or control the work AND CONTRACTORS BUILDING NEW ONE-FAMILY RESIDENTIAL CONSTRUCTION, when constructing or demolishing buildings or doing any excavating in connection therewith, shall comply with the following requirements: § 3. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
