BILL NUMBER: S6650 SPONSOR: THOMAS TITLE OF BILL: An act to amend the education law, in relation to remote programs for mandatory continuing education PURPOSE: To ensure that continuing education webinars are constructed in a manner that meets accessibility standards for the hearing and/or visually impaired. SUMMARY OF PROVISIONS: Section one of the bill amends the education law by adding a new section 6505e which states that all continuing education courses offered through remote means with a visual or auditory prompt for participants to respond to as proof of attendance shall conform to the most recent guidelines for website content accessibility guidelines (WCAG). A civil penalty of $1,000 may be imposed for each violation of the section.

THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to remote programs for mandatory continuing education THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 6505-e to read as follows: § 6505-E. REMOTE PROGRAMS FOR MANDATORY CONTINUING EDUCATION. 1. WHENEVER THE PRACTICE OF A PROFESSION WHICH IS LICENSED BY THE STATE SHALL REQUIRE THE COMPLETION OF MANDATORY CONTINUING EDUCATION, ANY PROGRAM DESIGNED AND APPROVED TO FULFILL SUCH REQUIREMENT WHICH IS OFFERED TO BE DELIVERED ELECTRONICALLY OR BY OTHER REMOTE MEANS WHERE THE LICENSEE MUST PROVIDE PROOF OF ATTENDANCE BY RESPONDING TO A VISUAL OR AUDITORY PROMPT IN THE PROGRAM SHALL CONFORM TO THE MOST RECENT GUIDELINES FOR WEBSITE CONTENT ACCESSIBILITY GUIDELINES (WCAG). 2. A CIVIL PENALTY OF ONE THOUSAND DOLLARS MAY BE IMPOSED FOR EACH VIOLATION OF THIS SECTION. § 2. This act shall take effect on the thirtieth day after it shall have become a law.
