TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to registration
fees for certain vehicles

 
PURPOSE OR GENERAL IDEA OF BILL:

To increase registration fees for passenger vehicles weighing 5,000
pounds or more.

 
SUMMARY OF PROVISIONS:

Section one amends paragraph a of subdivision 6 of Section 401 of the
Vehicle and Traffic Law by:

- Increasing registration fees for passenger vehicles that weigh between
5,001 and 6,000 pounds from one dollar and twenty-one cents to six
dollars and forty cents for every one hundred pounds of vehicle weight
over 3,500 pounds.

- Increasing registration fees for passenger vehicles that weigh between
6,001 and 7,000 pounds from one dollar and twenty-one cents to ten
dollars and forty cents for every one hundred pounds of vehicle weight
over 3,500 pounds.

- Increasing registration fees for passenger vehicles that weigh over
7,000 pounds from one dollar and twenty-one cents to eleven dollars and
forty cents for every one hundred pounds of vehicle weight over 3,500
pounds.

- Subtracting 1,000 pounds from the weight of an electric vehicle for
the purposes of calculating registration fees.

- Providing a waiver for individuals who need an oversized vehicle for
their employment, exempting these individuals from registration fee
increases.

Section two sets the effective date.

 
JUSTIFICATION:

In a ten year span between 2009 and 2019, pedestrian deaths from vehi-
cles rose an estimated 51 to 87 percent. In the first three months of
2023, 51 people were killed in NYC alone by vehicles.  Individuals hit
by vehicles weighing more than 4,000 pounds are between two to three
times more likely to die than those hit by smaller cars. A study found
that in the average U.S. metro area, there is a 2.4 percent increase in
pedestrian deaths for every 100 kilogram increase in vehicle weight. As
the street safety crisis continues to escalate, vehicles are only
getting heavier. Since 2000, average vehicle weight has increased nearly
11 percent, and since 1980, vehicle weight has increased by roughly
1,000 pounds. Light trucks (pickups, SUVs, minivans) now make up more
than 75 percent of cars sold.

While vehicle weight has increased, hood height has also increased 11
percent since 2000. Some vehicles have a hood height that is taller than
elementary school students, meaning they may not be able to see these
children stepping out into a crosswalk before catastrophe.  These vehi-
cles must also have wider pillars for the roof to support the vehicle's
increased weight, impacting the driver's peripheral vision.

Oversized vehicles have additional consequences. For every 1,000 pound
increase in vehicle weight, there is a 47 percent increase in fatality
probability for the occupants of the other impacted vehicle.  These
vehicles pollute more than smaller vehicles and cause more wear and tear
on their tires and brakes and on the roads, releasing toxic pollutants
and requiring more road maintenance.

A study found that the total external cost of vehicle weight is $93
billion. It estimated that SUVs would need to cost $750 more to
adequately account for the societal risk to pedestrians, cyclists, and
other drivers. This bill seeks to internalize some of these costs in
NYS.

 AN ACT to amend the vehicle and traffic law, in relation to registration
   fees for certain vehicles
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph a of subdivision 6 of section 401 of the  vehicle
 and  traffic law, as amended by section 1 of part G of chapter 59 of the
 laws of 2009, is amended to read as follows:
   a. The following fees shall be paid to  the  commissioner,  or  agent,
 upon  the registration or reregistration of a motor vehicle, including a
 suburban, in accordance with the provisions of this article:
   If such motor vehicle,  fully  equipped,  weighs  thirty-five  hundred
 pounds  or  less,  eighty-one cents for each one hundred pounds or major
 fraction thereof; if such motor vehicle,  fully  equipped,  weighs  more
 than  thirty-five hundred pounds AND LESS THAN OR EQUAL TO FIVE THOUSAND
 POUNDS, eighty-one cents for each one hundred pounds up  to  thirty-five
 hundred  pounds,  and  one  dollar and twenty-one cents for each hundred
 pounds, or major fraction thereof,  in  excess  of  thirty-five  hundred
 pounds;  IF  SUCH  MOTOR  VEHICLE, FULLY EQUIPPED, WEIGHS MORE THAN FIVE
 THOUSAND POUNDS AND LESS THAN OR EQUAL TO SIX THOUSAND  POUNDS,  EIGHTY-
 ONE  CENTS FOR EACH ONE HUNDRED POUNDS UP TO THIRTY-FIVE HUNDRED POUNDS,
 AND SIX DOLLARS AND FORTY CENTS FOR EACH HUNDRED POUNDS, OR MAJOR  FRAC-
 TION  THEREOF,  IN  EXCESS  OF THIRTY-FIVE HUNDRED POUNDS; IF SUCH MOTOR

 DOLLARS AND FORTY CENTS FOR EACH HUNDRED POUNDS, OR MAJOR FRACTION THER-
 EOF,  IN  EXCESS  OF THIRTY-FIVE HUNDRED POUNDS; provided, however, that
 the total fees for the registration or reregistration of any SIX,  EIGHT
 OR  TWELVE  CYLINDER  passenger  motor  vehicle propelled by electricity
 shall be [sixteen dollars and eighteen cents, of a six, eight, or twelve
 cylinder motor vehicle not less than sixteen dollars and eighteen cents,
 and of any other motor vehicle not less than twelve dollars and  ninety-
 five  cents];  AS  OTHERWISE  PROVIDED IN THIS PARAGRAPH EXCEPT THAT ONE
 THOUSAND POUNDS SHALL BE SUBTRACTED FROM THE WEIGHT OF SUCH  VEHICLE  IN
 CALCULATING  THE  FEE  and  provided  further  that  for  motor vehicles
 described in subdivision seven of this section, the fee for such  regis-
 tration shall be as therein prescribed.  PROVIDED FURTHER, HOWEVER, THAT
 AN  OWNER  MAY  APPLY  FOR A WAIVER FOR A PORTION OF THE FEES UNDER THIS
 PARAGRAPH IF SUCH OWNER SUBMITS PROOF  TO  THE  COMMISSIONER  THAT  THEY
 REQUIRE A LARGER VEHICLE FOR THEIR EMPLOYMENT OR WORK ACTIVITIES. UPON A
 GRANT  OF SUCH WAIVER THE REGISTRATION FEE WOULD BE EIGHTY-ONE CENTS FOR
 EACH ONE HUNDRED POUNDS UP TO THIRTY-FIVE HUNDRED POUNDS, AND ONE DOLLAR
 AND TWENTY-ONE CENTS FOR EACH HUNDRED POUNDS, OR MAJOR FRACTION THEREOF,
 IN EXCESS OF THIRTY-FIVE HUNDRED POUNDS. Provided further, however, that
 the maximum registration fee  under  this  paragraph  shall  not  exceed
 [seventy dollars and eight cents] THREE HUNDRED FIFTY DOLLARS per regis-
 tration  year.  For the purposes of this section a "suburban" shall be a
 motor vehicle with a convertible or interchangeable body or with remova-
 ble seats, usable for both passenger and delivery purposes, and  includ-
 ing  motor  vehicles,  commonly  known  as  station or depot wagons. The
 manufacturer's weight of motor vehicle shall be accepted as  the  weight
 for the purpose of registration under this paragraph.
   §  2.  This  act shall take effect on the thirtieth day after it shall
 have become a law.

PURPOSE OR GENERAL IDEA OF BILL:

To incrementally increase registration and reregistration fees for
certain vehicles.

 
SUMMARY OF PROVISIONS:

Section 1 amends paragraph a of subdivision 6 of section 401 of the
Vehicle and Traffic Law by:

- Ending the current fee schedule for the registration and reregistra-
tion of vehicles set by this paragraph on January 1, 2024;

- Authorizing the Commissioner to gradually increase registration and
reregistration fees until 2030, when they must meet the fee schedules
established in newly added paragraph, a-ii;

- Subtracting 1,000 pounds from the weight of electric vehicles that
weigh 5,000 pounds or less for the purposes of calculating registration
fees at a rate of 10 cents per pound.

Section 2 repeals subdivision 21 of section 401 of the Vehicle and Traf-
fic Law and replaces it with a new subdivision 21 that deposits regis-
tration and reregistration fees in the Highway and Bridge Trust fund and
Mass Transportation Trust Fund until each fund's annual financial plan
is met. This section would then require that 75 percent of remaining
funds be used for street safety projects and 25 percent of remaining
funds be used for state and local roadway projects.

Section 3 requires the Commissioner to issue a report annually that
lists, by county, the street safety projects and roadway improvement
projects funded through the new subdivision 21 of section 401 of the
Vehicle and Traffic Law, as established in section two of this bill.
This section also requires the report include county-level vehicle
weight data, the number of vehicles receiving a fee reduction for
producing zero emissions, and the number of vehicles involved in crashes
with pedestrians, cyclists, and other vehicles resulting in serious
injuries or fatalities.

Section 4 sets the effective date.

 graphs a-1 and a-2 are added to read as follows:
   [The] PRIOR TO JANUARY FIRST, TWO THOUSAND TWENTY-FOUR, THE  following

 or reregistration of a motor vehicle, including a suburban,  in  accord-
 ance with the provisions of this article:
   A-1.  BEGINNING IN TWO THOUSAND TWENTY-FOUR, THE COMMISSIONER SHALL BE

   (IV) NOTWITHSTANDING SUBPARAGRAPHS (I) AND (II) OF THIS PARAGRAPH, FOR
 MOTOR VEHICLES DESCRIBED IN SUBDIVISION SEVEN OF THIS SECTION,  THE  FEE
 FOR SUCH REGISTRATION SHALL BE AS THEREIN PRESCRIBED.
   (V)  THE  CURB WEIGHT OF MOTOR VEHICLE SHALL BE ACCEPTED AS THE WEIGHT
 FOR THE PURPOSE OF REGISTRATION AND REREGISTRATION UNDER THIS PARAGRAPH.
   § 2. Subdivision 21 of section 401 of the vehicle and traffic  law  is
 REPEALED and a new subdivision 21 is added to read as follows:
   21.  A.  THE  COMMISSIONER  SHALL DEPOSIT DAILY THE PERCENTAGES LISTED
 BELOW OF ALL FEES COLLECTED OR RECEIVED BY THE COMMISSIONER PURSUANT  TO
 CERTAIN  REGISTRATION  FEES IMPOSED BY (I) PARAGRAPHS A, A-ONE AND A-TWO
 OF SUBDIVISION SIX OF THIS SECTION, (II) ALL  SCHEDULES  OF  SUBDIVISION
 SEVEN  OF  THIS  SECTION,  AND (III) PARAGRAPH A OF SUBDIVISION EIGHT OF
 THIS SECTION IN A RESPONSIBLE BANK,  BANKING  HOUSE  OR  TRUST  COMPANY,
 WHICH  SHALL  PAY  THE  HIGHEST  RATE  OF INTEREST TO THE STATE FOR SUCH
 DEPOSIT TO THE CREDIT OF THE COMPTROLLER ON  ACCOUNT  OF  THE  DEDICATED
 HIGHWAY  AND  BRIDGE  TRUST FUND ESTABLISHED PURSUANT TO SECTION EIGHTY-
 NINE-B OF THE STATE FINANCE LAW. ANNUALLY,  THE  COMMISSIONER  SHALL  SO

 DEPOSIT  SUCH  REGISTRATION FEES SO COLLECTED OR SO RECEIVED AFTER MARCH
 THIRTY-FIRST, TWO THOUSAND TWENTY-FOUR UNTIL SUCH  TIME  AS  THE  ANNUAL
 FINANCIAL  PLAN  OF  THE DEDICATED HIGHWAY AND BRIDGE TRUST FUND AND THE
 DEDICATED  MASS  TRANSPORTATION TRUST FUND ARE MET. THEREAFTER, SEVENTY-
 FIVE PERCENT OF SUCH REGISTRATION FEES COLLECTED SHALL  BE  DIRECTED  TO
 FUNDING  NEW  STATE  AND  LOCAL STREET SAFETY PROJECTS INCLUDING BUT NOT
 LIMITED TO PROTECTED BIKE LANES, BOLLARDS, ROAD DIETS, PEDESTRIANIZATION
 OF STREETS, PEDESTRIAN ISLANDS, RAISED CROSSWALKS, CHICANES, TURN  CALM-
 ING,  RUMBLE  STRIPS, LEADING PEDESTRIAN INTERVALS AND CURB AND SIDEWALK
 EXTENSIONS.  THE REMAINING TWENTY-FIVE PERCENT  SHALL  BE  EXPENDED  FOR
 MAINTENANCE,  REPAIR,  AND  REVITALIZATION  OF STATE AND LOCAL ROADWAYS,
 WITH A PREFERENCE FOR PROJECTS THAT UTILIZE GREEN ASPHALT.   THE  AFORE-
 MENTIONED  FUNDS  FOR STREET SAFETY AND ROADWAY PROJECTS SHALL BE PRIOR-
 ITIZED FOR USE IN LOCAL PROJECTS BEFORE USE IN STATE  PROJECTS.    EVERY
 BANK,  BANKING  HOUSE  OR TRUST COMPANY THAT ACCEPTS SUCH DEPOSITS SHALL
 EXECUTE AND FILE IN THE OFFICE OF THE DEPARTMENT OF AUDIT AND CONTROL AN
 UNDERTAKING TO THE STATE, IN THE SUM, AND WITH  SUCH  SURETIES,  AS  ARE
 REQUIRED AND APPROVED BY THE COMPTROLLER FOR THE SAFE KEEPING AND PROMPT
 PAYMENT ON LEGAL DEMAND THEREFOR OF ALL SUCH MONEYS HELD BY OR ON DEPOS-
 IT  IN SUCH BANK, BANKING HOUSE, OR TRUST COMPANY, WITH INTEREST THEREON
 ON DAILY BALANCES AT SUCH RATE AS THE COMPTROLLER MAY  FIX.  EVERY  SUCH
 UNDERTAKING  SHALL HAVE ENDORSED THEREON OR ANNEXED THERETO THE APPROVAL
 OF THE ATTORNEY GENERAL AS TO ITS FORM.
   B. OF THE REVENUES SO DEPOSITED, THE COMPTROLLER SHALL RETAIN IN THEIR
 HANDS SUCH AMOUNT AS THE COMMISSIONER MAY DETERMINE TO BE NECESSARY  FOR
 REFUNDS  OR REIMBURSEMENTS OF THE FEES COLLECTED OR RECEIVED PURSUANT TO
 (I) PARAGRAPHS A, A-ONE AND A-TWO OF SUBDIVISION SIX  OF  THIS  SECTION,
 (II) ALL SCHEDULES OF SUBDIVISION SEVEN OF THIS SECTION, AND (III) PARA-
 GRAPH  A OF SUBDIVISION EIGHT OF THIS SECTION TO WHICH REGISTRANTS SHALL
 BE ENTITLED UNDER THE PROVISIONS OF THIS ARTICLE, OUT  OF  WHICH  AMOUNT
 THE  COMMISSIONER  SHALL  PAY  ANY REFUNDS OR REIMBURSEMENTS OF THE FEES
 COLLECTED OR RECEIVED PURSUANT TO  PARAGRAPHS  A,  A-ONE  AND  A-TWO  OF
 SUBDIVISION  SIX,  ALL SCHEDULES OF SUBDIVISION SEVEN AND PARAGRAPH A OF
 SUBDIVISION EIGHT OF THIS SECTION TO WHICH REGISTRANTS SHALL BE ENTITLED
 UNDER SUCH PROVISIONS. THE COMPTROLLER, AFTER RESERVING  THE  AMOUNT  TO
 PAY  SUCH REFUNDS OR REIMBURSEMENTS, SHALL, ON OR BEFORE THE LAST DAY OF
 EACH MONTH, DEPOSIT THE BALANCE OF THE REVENUE SO DEPOSITED DURING  SUCH
 MONTH  INTO  THE  DEDICATED  HIGHWAY  AND  BRIDGE TRUST FUND ESTABLISHED
 PURSUANT TO SECTION EIGHTY-NINE-B OF THE STATE FINANCE LAW AND THE  MASS
 TRANSPORTATION  TRUST FUND ESTABLISHED PURSUANT TO SECTION EIGHTY-NINE-C
 OF THE STATE FINANCE LAW.
   C. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF THIS SECTION,  ELEVEN
 DOLLARS  AND  FIFTY CENTS OF THE REGISTRATION FEES COLLECTED PURSUANT TO
 PARAGRAPH A OF SUBDIVISION FIVE OF SECTION  FOUR  HUNDRED  TEN  OF  THIS
 TITLE SHALL BE DEPOSITED PURSUANT TO THIS SUBDIVISION. THREE DOLLARS AND
 FIFTY  CENTS  OF SUCH FEES COLLECTED IN RELATION TO APPLICATIONS FOR NEW
 REGISTRATIONS AND RENEWALS OF EXISTING REGISTRATIONS SHALL BE  DEPOSITED
 TO  THE  CREDIT  OF  THE  DEDICATED  HIGHWAY  AND BRIDGE TRUST FUND. TWO
 DOLLARS AND FIFTY CENTS OF SUCH REGISTRATION  FEES  SHALL  BE  DEPOSITED
 INTO  THE MOTORCYCLE SAFETY FUND ESTABLISHED PURSUANT TO SECTION NINETY-
 TWO-G OF THE STATE FINANCE LAW.
   § 3. The commissioner of the department of transportation shall submit
 a report to the governor and the legislature  annually  that  lists,  by
 county,  the  street  safety  projects  and roadway improvement projects
 funded by paragraph a of  subdivision 21 of section 410 of  the  vehicle
 and  traffic  law, as added by section two of this act. The report shall

 also include, by county, vehicle weight data,  the  number  of  vehicles
 receiving a fee reduction for producing zero emissions and the number of
 vehicles  categorized  by vehicle weight involved in crashes with pedes-
 trians,  cyclists  or  other  vehicles  resulting in serious injuries or
 fatalities.  The report shall be made publicly available on the  depart-
 ment of transportation website.
   § 4. This act shall take effect January 1, 2024.
