BILL NUMBER: S6663 SPONSOR: BRESLIN TITLE OF BILL: An act to amend the social services law, in relation to directing the commissioner of health to authorize additional reimbursement to provid- ers of health and dental care primarily serving individuals with intel- lectual and developmental disabilities for certain services PURPOSE: This bill would require the commissioner of the department of health to authorize additional medicaid reimbursement to providers of health and dental care primarily serving individuals with intellectual and develop- mental disabilities for uncompensated time, use of staff, and services that are necessary to support treatment of a patient as a result of the patient's physical, intellectual, or developmental disability and require that such additional reimbursement be sufficient to cover the actual cost of providing such necessary support services associated with treatment.

BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to directing the commissioner of health to authorize additional reimbursement to providers of health and dental care primarily serving individuals with intellectual and developmental disabilities for certain services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The social services law is amended by adding a new section 365-p to read as follows: § 365-P. ADDITIONAL REIMBURSEMENT. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COMMISSIONER OF HEALTH SHALL AUTHORIZE ADDITIONAL REIMBURSE- MENT TO PROVIDERS OF HEALTH AND DENTAL CARE PRIMARILY SERVING INDIVID- UALS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES FOR UNCOMPENSATED TIME, USE OF STAFF, AND SERVICES THAT ARE NECESSARY TO SUPPORT TREATMENT OF A PATIENT AS A RESULT OF THE PATIENT'S PHYSICAL, INTELLECTUAL, OR DEVELOPMENTAL DISABILITY. SUCH ADDITIONAL REIMBURSEMENT SHALL BE SUFFI- CIENT TO COVER THE ACTUAL COST OF PROVIDING SUCH NECESSARY SUPPORT SERVICES ASSOCIATED WITH TREATMENT. § 2. This act shall take effect immediately.
