 Introduced by Sen. FERNANDEZ -- read twice and ordered printed, and when
   printed to be committed to the Committee on Transportation
 
 AN  ACT  to  amend the vehicle and traffic law, in relation to requiring
   that all terrain vehicles only be filled with gas when  on  a  tow  or
   trailer

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 2404 of the vehicle and traffic law is  amended  by
 adding a new subdivision 4-a to read as follows:
   4-A.  (A) FOR PURPOSES OF THIS SUBDIVISION, "RETAIL GAS STATION" MEANS
 A FILLING STATION WHERE MOTOR FUEL OR DIESEL MOTOR FUEL IS STORED PRIMA-
 RILY FOR SALE BY DELIVERY DIRECTLY INTO THE ORDINARY FUEL TANK CONNECTED
 WITH THE ENGINE OF A MOTOR VEHICLE TO BE CONSUMED IN  THE  OPERATION  OF
 SUCH MOTOR VEHICLE.
   (B)  IT  SHALL  BE PROHIBITED FOR AN INDIVIDUAL TO FILL AN ALL TERRAIN
 VEHICLE WITH MOTOR FUEL AT A RETAIL GAS STATION UNLESS SUCH ALL  TERRAIN
 VEHICLE IS BEING TOWED OR TRAILED BY ANOTHER MOTOR VEHICLE.
   (C) EVERY RETAIL GAS STATION SHALL POST A SIGN IN A CLEAR AND CONSPIC-
 UOUS MANNER INDICATING TO CUSTOMERS THAT ANY ALL TERRAIN VEHICLE MUST BE
 ON A TOW OR TRAILER WHEN BEING FILLED WITH GAS.
   §  2.  This  act shall take effect on the thirtieth day after it shall
 have become a law.
