BILL NUMBER: S6860 SPONSOR: RYAN TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to allow for a propOsed establishment on Main Street in the Village of Williamsville to be able to obtain a retail license for on-premises consumption even though it is located within two hundred feet of a building occupied as a school or place of worship. SUMMARY OF PROVISIONS: Section 1 amends Subdivision 7 of section 64 of the alcoholic beverage control law, as added a new paragraph e-15, to authorize the State Liquor Authority to issue a retail license for on-premises consumption for a premises which shall be located within two hundred feet of a

RYAN -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-15) to read as follows: (E-15) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A SCHOOL, CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF ERIE, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT TRACT OR PARCEL OF LAND, SITUATE IN THE VILLAGE OF WILLIAMS- VILLE, TOWN OF AMHERST, COUNTY OF ERIE AND STATE OF NEW YORK, BEING PART OF LOT NO. 1, TOWNSHIP 12, RANGE 4 OF THE HOLLAND LAND COMPANY'S SURVEY, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT THE INTERSECTION OF THE NORTHERLY LINE OF MAIN STREET (99 FEET WIDE) WITH THE WESTERLY LINE OF GROVE STREET (20 FEET WIDE); RUNNING THENCE NORTHERLY ALONG THE WESTERLY LINE OF GROVE STREET, A DISTANCE OF 111.52 FEET TO A POINT; THENCE WESTERLY PARALLEL WITH THE NORTHERLY LINE OF MAIN STREET A DISTANCE OF 51.50 FEET TO A POINT; THENCE SOUTHERLY PARALLEL WITH THE WESTERLY LINE OF GROVE, A DISTANCE OF 59.13 FEET TO THE NORTHWEST CORNER OF LANDS CONVEYED TO MICHAEL A.
