BILL NUMBER: S6870 SPONSOR: OBERACKER TITLE OF BILL: An act extending the time within which certain elected officers may file their oaths of office PURPOSE: This bill grants elected officials in the Village of Middleburgh, who failed to file their oaths of office as statutorily required, additional time to become compliant and serve out the remainder of their terms. SUMMARY OF PROVISIONS: Section one of this bill provides that elected officials in the Village of Middleburgh, as of the last village-wide election, who failed to take their oaths of office within the statutorily prescribed period, shall continue to serve in such capacity through the remainder of their term if such oaths are filed within thirty days of enactment.

OBERACKER -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT extending the time within which certain elected officers may file their oaths of office THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any law, rule, or regulation to the contra- ry, any duly elected village officer or officers within the village of Middleburgh, in the county of Schoharie, as of the last village-wide election that failed to take or file their respective oaths of office within the statutorily prescribed period shall continue to serve in such capacity and for the term from October 1, 2020 through November 30, 2023 upon the taking and filing of oaths of office consistent with section 3-312 of the village law provided such oaths are taken within 30 days from the effective date of this act. Such village officer or officers that take and file their oaths of office within 30 days of the effective date of this act shall be deemed to have been continuously serving in office as of October 1, 2020. § 2.
