BILL NUMBER: S6913 SPONSOR: ADDABBO TITLE OF BILL: An act to amend the agriculture and markets law, in relation to includ- ing use of a deadly weapon or dangerous instrument as an aggravated cruelty offense PURPOSE OR GENERAL IDEA OF BILL: Because of the difficulty inherent in proving "serious physical injury" (SPI) to companion animals, this legislation would elevate the penalty for causing physical injury to such animals through, use of a deadly weapon or dangerous instrument while intending to cause serious physical injury. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends Section 353-a of the agriculture and markets law to provide that a person is guilty of aggravated cruelty to animals when such person, with no justifiable purpose, causes physical injury to a

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to includ- ing use of a deadly weapon or dangerous instrument as an aggravated cruelty offense THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 353-a of the agriculture and markets law, as added by chapter 118 of the laws of 1999, is amended to read as follows: 1. A person is guilty of aggravated cruelty to animals when, with no justifiable purpose, he or she: (A) intentionally kills or intentionally causes serious physical inju- ry to a companion animal with aggravated cruelty; OR (B) WITH INTENT TO KILL OR CAUSE SERIOUS PHYSICAL INJURY TO A COMPAN- ION ANIMAL WITH AGGRAVATED CRUELTY, CAUSES PHYSICAL INJURY TO A COMPAN- ION ANIMAL BY MEANS OF A DEADLY WEAPON AS DEFINED IN SUBDIVISION TWELVE OF SECTION 10.00 OF THE PENAL LAW, OR BY MEANS OF A DANGEROUS INSTRUMENT AS DEFINED IN SUBDIVISION THIRTEEN OF SECTION 10.00 OF THE PENAL LAW. For purposes of this section, "aggravated cruelty" shall mean conduct which: (i) is intended to cause extreme physical pain; or (ii) is done or carried out in an especially depraved or sadistic manner. § 2.
