BILL NUMBER: S6961 SPONSOR: BORRELLO TITLE OF BILL: An act to amend the public officers law, in relation to requiring public access to state budget discussions PURPOSE: This bill would require meetings held between the Speaker of the Assem- bly, Temporary President of the Senate, and the Governor to discuss, negotiate, or debate, in part or in its entirety, the provisions of the state budget to be open to the public. SUMMARY OF PROVISIONS: Section 1: Creates a new section 103-B of the Public Officers Law to require meetings between the legislative leaders and the governor to be open to the public, the host of the meeting to provide the public to attend the meeting in at least one physical location at which a member participates, and requires meetings to be broadcast to the public when

BORRELLO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to requiring public access to state budget discussions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public officers law is amended by adding a new section 103-b to read as follows: § 103-B. PUBLIC ACCESS TO STATE BUDGET DISCUSSIONS. 1. NOTWITHSTAND- ING THE PROVISIONS OF THIS ARTICLE, OR ANY OTHER LAW TO THE CONTRARY, EVERY MEETING OF THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY ARRANGED TO DISCUSS, NEGOTIATE, OR DEBATE, IN PART OR IN ITS ENTIRETY, THE PROVISIONS OF THE STATE BUDGET, SHALL BE OPEN TO THE GENERAL PUBLIC. 2. THE HOST OF THE MEETINGS UNDER THIS SECTION SHALL PROVIDE AN OPPOR- TUNITY FOR THE PUBLIC TO ATTEND, LISTEN AND OBSERVE THE MEETINGS IN AT LEAST ONE PHYSICAL LOCATION AT WHICH A MEMBER PARTICIPATES AND SHALL BE OPEN TO BEING PHOTOGRAPHED, BROADCAST, WEBCAST, OR OTHERWISE RECORDED AND/OR TRANSMITTED BY AUDIO OR VIDEO MEANS. 3. MEETINGS UNDER THIS SECTION SHALL, TO THE EXTENT PRACTICABLE, BE BROADCAST TO THE PUBLIC AND MAINTAINED AS RECORDS BY THE OFFICE OF THE GOVERNOR AND EACH HOUSE OF THE LEGISLATURE AND STREAMED ON THE WEBSITES OF THE GOVERNOR, THE SENATE AND THE ASSEMBLY IN REAL-TIME AND POSTED ON SUCH WEBSITES WITHIN AND FOR A REASONABLE TIME AFTER THE MEETING. § 2.
