BILL NUMBER: S7061 SPONSOR: BAILEY TITLE OF BILL: An act to designate certain zip codes as cease and desist zones PURPOSE OR GENERAL IDEA: The purpose of this legislation is to stop intense and repeated solic- itation by real estate brokers and salespersons within the geographic areas of The Bronx and Mount Vernon. SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill adds all of the zip codes of The Bronx and Mount Vernon to the relevant provisions of the real property law so as to make those areas cease and desist zones. Section two of the bill sets forth the effective date. JUSTIFICATION:

BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to designate certain zip codes as cease and desist zones THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other law, rule or regulation to the contrary, the secretary of state shall establish by rule a cease and desist zone, pursuant to subdivision 3 of section 442-h of the real property law, consisting of the following zip codes within ninety days of the effective date of this act: 10451, 10452, 10453, 10454, 10455, 10456, 10457, 10458, 10459, 10460, 10461, 10462, 10463, 10464, 10465, 10466, 10467, 10468, 10469, 10470, 10471, 10472, 10473, 10474, 10475, 10550, 10551, 10552, and 10553. The rule establishing such cease and desist zone shall be effective for five years, provided the secretary of state may re-adopt the rule to continue the cease and desist zone pursu- ant to paragraph (c) of subdivision 3 of section 442-h of the real prop- erty law. § 2.
