BILL NUMBER: S7228 SPONSOR: RHOADS TITLE OF BILL: An act to amend the labor law, in relation to apprenticeship training PURPOSE: To establish a minimum graduation rate to qualify for certification as a certified apprenticeship program. SUMMARY OF PROVISIONS: Amends Section 811 of the Labor Law to re-letter paragraphs (k) and (1) as paragraphs (1) and (m) respectively, and to add a new paragraph (k), which requires that apprenticeship prograMs under this section be specific to the type and scope of work which is being performed and have a graduation rate of at least thirty percent under criteria established by the Department of Labor.

RHOADS, MATTERA -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to apprenticeship training THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The section heading, the opening paragraph of subdivision 1 and subdivision 2 of section 811 of the labor law, the section heading and the opening paragraph of subdivision 1 as amended by chapter 482 of the laws of 1961 and subdivision 2 as amended by chapter 51 of the laws of 1968, are amended to read as follows: Powers and duties of [industrial] THE commissioner; personnel. The [industrial] commissioner shall have the following powers and duties: 2. The [industrial] commissioner shall appoint a person who shall be in charge of apprentice training in the department [of labor], and who shall act as secretary of the state apprenticeship and training council and of state joint apprenticeship committees. The [industrial] commis- sioner is further authorized to appoint such clerical, technical, and professional assistants as shall be necessary to effectuate the purposes of this article. The personnel appointed under this article shall receive an annual compensation to be fixed by the [industrial] commis- sioner within the amount provided by appropriation. § 2. Paragraphs (k) and (l) of subdivision 1 of section 811 of the labor law, as relettered by chapter 825 of the laws of 2021, are relet- tered (l) and (m) and a new paragraph (k) is added to read as follows: (K) TO REQUIRE SUCH APPRENTICESHIP PROGRAM IS SPECIFIC TO THE TYPE AND SCOPE OF WORK WHICH IS BEING PERFORMED AND HAVE A GRADUATION RATE OF AT LEAST THIRTY PERCENT AS DETERMINED BY THE DEPARTMENT. § 3.
