TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to authorizing
the spouses of certain volunteer firefighters to be issued a distinctive
license plate for volunteer firefighters

 
PURPOSE:

An act to amend the vehicle and traffic law, in relation to authorizing
the spouses of certain volunteer firefighters to be issued a distinctive
license plate for volunteer firefighters.

 
SUMMARY OF PROVISIONS:

Section 1. Subdivision 1 of section 404-b of the vehicle and traffic
law, as amended by chapter 277 of the laws of 1991, is amended to read
as follows:

1. Any member of any volunteer fire department or company in this state

or and the spouse of any such member shall, upon request, be issued a
license plate bearing a Maltese cross and the letters "V.F.". If a
distinctive plate is issued to any such member pursuant to this section.

member.) Application for said such license plate shall be filed with the
commissioner in such form and detail as the commissioner shall
prescribe, and shall be verified annually by the applicant and the
spouse.

 
JUSTIFICATION:

A firefighter should be allowed to have two sets of plates in case
he/she is using another self-owned vehicle and needs to rush to a fire
call; as long as both vehicles are registered under his or her name, or
collectively with a spouse. Many times, when rushing to a call, a red
light or speed camera or other traffic controlling/monitoring device
will ticket a firefighter's "other" vehicle of which does not have the
distinctive plate.

 AN  ACT to amend the vehicle and traffic law, in relation to authorizing
   the spouses of certain volunteer firefighters to be issued a  distinc-
   tive license plate for volunteer firefighters

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section 404-b of the vehicle  and  traffic
 law,  as  amended by chapter 277 of the laws of 1991, is amended to read
 as follows:
   1. Any member of any volunteer fire  department  or  company  in  this
 state  [or]  AND  the  spouse of any such member shall, upon request, be
 issued a license plate bearing a Maltese cross and the  letters  "V.F.".
 [If  a  distinctive  plate is issued to any such member pursuant to this
 section, such a distinctive plate shall not be issued to the  spouse  of
 such  member.]  Application for [said] SUCH license plate shall be filed
 with the commissioner in such form and detail as the commissioner  shall
 prescribe,  and  shall  be  verified  annually  by the applicant AND THE
 SPOUSE.
   § 2. This act shall take effect immediately.
