BILL NUMBER: S749 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the public authorities law, in relation to requiring at least one electric charging station for every one hundred fifty thousand New York state residents PURPOSE OR GENERAL IDEA OF BILL: To establish a minimum number of publicly available electric vehicle charging stations per residents. SUMMARY OF PROVISIONS: Section 1 amends subdivision 9-a of section 1005 of the public authori- ties law to mandate that the New York Power Authority be responsible for the installation and operation of electric vehicle charging stations per every 150,000 residents in the state. SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public authorities law, in relation to requiring at least one electric charging station for every one hundred fifty thou- sand New York state residents THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 9-a of section 1005 of the public authorities law, as added by section 1 of part KK of chapter 58 of the laws of 2019, is amended to read as follows: 9-a. [As deemed feasible and advisable by the trustees, to] TO design, finance, develop, construct, install, lease, operate and maintain elec- tric vehicle charging stations throughout the state for use by the public, WITH AT LEAST ONE CHARGING STATION FOR EVERY ONE HUNDRED FIFTY THOUSAND NEW YORK STATE RESIDENTS. THE CONSTRUCTION AND DEVELOPMENT OF SUCH ELECTRIC VEHICLE CHARGING STATIONS SHALL COMPLY WITH THE PROVISIONS OF ARTICLE EIGHT OF THE LABOR LAW, INCLUDING THE PAYMENT OF A WAGE OF NOT LESS THAN THE PREVAILING WAGE IN THE LOCALITY WHERE SUCH ELECTRIC VEHICLE CHARGING STATION IS LOCATED. The authority shall annually post on their website a report on those activities undertaken pursuant to this subdivision, including but not limited to: the total number of electric vehicle charging stations in operation pursuant to such author- ization, the locations of such charging stations, and the total costs to the authority associated with such activities. § 2. THE DISTRIBUTION OF SUCH LEVEL THREE FAST CHARGING STATIONS SHALL BE SPREAD THROUGHOUT THE STATE AT THE COUNTY LEVEL, SO THAT EACH COUNTY SHALL RECEIVE ONE LEVEL THREE CHARGING STATION FOR EVERY FIVE THOUSAND NEW YORK STATE RESIDENTS LOCATED THEREIN. SITING OF CHARGING STATIONS SHALL BE PRIORITIZED IN HIGH TRAFFIC AREAS INCLUDING, BUT NOT LIMITED TO, HIGHWAY EXITS, TRANSIT HUBS, MUNICIPAL OR TOWN CENTERS, OR ANY OTHER WIDELY ACCESSIBLE LOCATION THE AUTHORITY DEEMS APPROPRIATE.
