BILL NUMBER: S7599 SPONSOR: ASHBY TITLE OF BILL: An act to amend the penal law, in relation to grand larceny in the fourth degree PURPOSE: To crack down on repeat offenders of petit larceny and shoplifting. SUMMARY OF PROVISIONS: Section 1 amends section 155.30 of the penal law by making a person who commits repeated thefts (petit larceny) guilty of grand larceny in the fourth degree (a Class E felony). Repeated thefts is defined as being convicted of petit larceny 2 times within any three month period, or 3 times with any twelve month period. Section 2 sets the effective date to immediately.

ASHBY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the penal law, in relation to grand larceny in the fourth degree THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 155.30 of the penal law is amended by adding a new subdivision 12 to read as follows: 12. THE PERSON HAS BEEN PREVIOUSLY CONVICTED OF PETIT LARCENY AS DEFINED IN SECTION 155.25 OF THIS ARTICLE TWO TIMES WITHIN ANY THREE MONTH PERIOD OR THREE TIMES WITHIN ANY TWELVE MONTH PERIOD. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11869-01-3
