BILL NUMBER: S7615 SPONSOR: TEDISCO TITLE OF BILL: An act in relation to prohibiting the relocation of migrants from one municipality to another municipality unless and until a resolution authorizing the relocation has been adopted by the governing bodies of both the receiving municipality where the migrants are to be relocated and the county in which the receiving municipality is located PURPOSE: To prohibit the relocation of migrants from one municipality to another municipality unless and until a resolution authorizing the relocation has been adopted by the governing bodies of both the receiving county and the receiving municipality SUMMARY OF PROVISIONS: § 1. Short title. This act shall be known and referred to as the "migrant home rule transfer and transparency act".

TEDISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT in relation to prohibiting the relocation of migrants from one municipality to another municipality unless and until a resolution authorizing the relocation has been adopted by the governing bodies of both the receiving municipality where the migrants are to be relocated and the county in which the receiving municipality is located THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and referred to as the "migrant home rule transfer and transparency act". § 2. Notwithstanding any provisions of law, rule or regulation to the contrary, no municipality shall relocate migrants from such municipality for the purpose of permanent or temporary housing to another munici- pality in New York unless and until a resolution authorizing the relo- cation has been adopted by the governing bodies of both the receiving municipality and the county in which the receiving municipality is located. Prior to the actual physical relocation of the migrants, the relocating municipality shall provide at least thirty days written notice to the receiving municipality of the impending relocation of such individuals. § 3. As used in this act: (i) "municipality" means a city, town, village or hamlet in New York state; (ii) "receiving municipality" means the municipality to which the migrants are to be transported; and (iii) "relocating municipality" means the municipality in which the migrants are currently housed and from which the migrants are to be relocated.
