BILL NUMBER: S7619 SPONSOR: BORRELLO TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to making conforming technical changes; and to repeal subdivi- sion 5 of section 192 of the agriculture and markets law, in relation to the requirement that any person, firm or corporation that sells or offers for sale at retail any motor fuel for use in internal combustion engines in motor vehicles or motorboats posts on the dispensing device signage stating the price per gallon of such motor fuel PURPOSE: To remove the requirement of pump topper signage for gas retailers when it is already posted by the road and electronically on the pumps. SUMMARY OF SPECIFIC PROVISIONS: Section One repeals subdivision 5 of Section 192 of the agriculture and markets law and renumbers subdivision 6 as subdivision 5.

BORRELLO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the administrative code of the city of New York, in relation to making conforming technical changes; and to repeal subdi- vision 5 of section 192 of the agriculture and markets law, in relation to the requirement that any person, firm or corporation that sells or offers for sale at retail any motor fuel for use in internal combustion engines in motor vehicles or motorboats posts on the dispensing device signage stating the price per gallon of such motor fuel THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 192 of the agriculture and markets law is REPEALED and subdivision 6 is renumbered subdivision 5. § 2. The opening paragraph of subdivision a of section 20-672 of the administrative code of the city of New York, as amended by local law number 79 of the city of New York for the year 2015, is amended to read as follows: [Except as provided in subdivision five of section one hundred nine- ty-two of the agriculture and markets law, it] IT shall be unlawful for any person, in connection with the sale or offer for sale at retail of any petroleum products for use in motor vehicles or motor boats, to post or maintain at such place of sale any sign, placard or other display that states the price at which such petroleum products are sold or offered for sale, except as follows: § 3.
