2023-S7620 (ACTIVE) - Summary

Prohibits the granting of a certificate for the construction or operation of an on-shore or off-shore industrial wind turbine or wind farm within the jurisdiction and control of the state and within any area of the state outside of the city of New York unless a certificate for the construction or operation of an on-shore or off-shore industrial wind turbine or wind farm within geographic boundaries of or the shoreline adjacent to the city of New York is granted simultaneously.

TITLE OF BILL:

An act to amend the public service law and the environmental conserva-
tion law, in relation to the granting of certificates for the
construction or operation of industrial wind turbines

 
PURPOSE:

To require equal placement of wind turbine construction and operation of
wind turbines in New York City proper compared to the rest of New York
State.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section one amends Section 168 of the public service law by adding new
subdivision 3a requiring the board not grant a certificate for the
construction or operation of an industrial wind turbine within New York
State, outside of New York City, without granting a certificate for the
construction or operation of a wind turbine within New York City.

Section two amend Section 15-0503 of the environmental conservation law
is amended by adding new subdivision 3a requiring the department not
grant a permit for the construction or operation of an industrial wind
turbine within New York State, outside of New York City, without grant-
ing a permit for the construction or operation of a wind turbine within
New York City.

Section three states this act shall take effect immediately.

 
JUSTIFICATION:

New York State has expressed their commitment to be the most progressive
state in the country when it comes to renewable energy.  They are blank-
eting upstate New York and Long Island with wind turbines without local
control and are threatening to put turbines in our Great Lakes and off
our east coast.

Those special interests pushing this conversion to all-renewables in our
state are largely from NYC. The five boroughs consume by far the most
energy and are also the most dependent on fossil fuels. Therefore, NYC
should shoulder an equal, if not greater, share of this burden to radi-
cally change our power generation.

If this is truly the "existential threat to humanity" that is often
referenced by those special interests, then the cost and logistical
challenges of placing industrial wind turbines in NYC should be faced
with the same vigor that it has been outside NYC.

 AN ACT to amend the public service law and the  environmental  conserva-
   tion  law,  in  relation  to  the  granting  of  certificates  for the
   construction or operation of industrial wind turbines

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 168 of the public service law is amended by adding
 a new subdivision 3-a to read as follows:
   3-A. THE BOARD MAY NOT GRANT A CERTIFICATE  FOR  THE  CONSTRUCTION  OR
 OPERATION  OF  AN  ON-SHORE OR OFF-SHORE INDUSTRIAL WIND TURBINE OR WIND
 FARM WITHIN THE JURISDICTION AND CONTROL OF THE  STATE  AND  WITHIN  ANY
 AREA  OF  THE  STATE  OUTSIDE  OF  THE CITY OF NEW YORK UNLESS THE BOARD
 SIMULTANEOUSLY GRANTS A CERTIFICATE FOR THE CONSTRUCTION OR OPERATION OF
 AN ON-SHORE OR OFF-SHORE INDUSTRIAL WIND TURBINE  OR  WIND  FARM  WITHIN
 GEOGRAPHIC  BOUNDARIES  OF  OR THE SHORELINE ADJACENT TO THE CITY OF NEW
 YORK.
   § 2. Section 15-0503 of the environmental conservation law is  amended
 by adding a new subdivision 3-a to read as follows:
   3-A.  THE  DEPARTMENT  MAY  NOT GRANT A PERMIT FOR THE CONSTRUCTION OR
 OPERATION OF AN ON-SHORE OR OFF-SHORE INDUSTRIAL WIND TURBINE WITHIN THE
 JURISDICTION AND CONTROL OF THE STATE AND WITHIN ANY AREA OF  THE  STATE
 OUTSIDE   OF  THE  CITY  OF  NEW  YORK  UNLESS  A  CERTIFICATE  FOR  THE
 CONSTRUCTION OR OPERATION OF AN ON-SHORE OR  OFF-SHORE  INDUSTRIAL  WIND
 TURBINE WITHIN GEOGRAPHIC BOUNDARIES OF OR THE SHORELINE ADJACENT TO THE
 CITY  OF  NEW  YORK IS ISSUED PURSUANT TO SUBDIVISION THREE-A OF SECTION
 ONE HUNDRED SIXTY-EIGHT OF THE PUBLIC SERVICE LAW.
   § 3. This act shall take effect immediately.
