TITLE OF BILL:

An act to amend the executive law, in relation to establishing an inven-
tory database to track the state's inventory of unused state-owned real
property

 
PURPOSE:

To identify all unused, abandoned or surplus real property that is owned
by New York State

 
SUMMARY OF PROVISIONS:

Section 1 amends executive law to require the office of general services
to create and maintain a database to be viewable by the public that
identifies and classifies all unused, abandoned or surplus real property
(including structures and facilities) that are owned by the State of New
York.

Each state agency and authority will be required to appoint an inventory
coordinator to be tasked with overseeing the documentation and classi-
fication of all unused, abandoned or surplus real property under the
purview of that agency/authority. The inventory coordinator has the
authority to establish an inventory team that will assist with the quar-
terly reporting requirements.

Section 2 sets the effective date to immediately.

 
JUSTIFICATION:

New York State cannot afford to squander taxpayer funds or grant money
on new resources when there are current facilities laying dormant and
ripe for repurposing. Other states like Colorado are already tracking
unused property. This legislation aims to step up NY's game by creating
an inventory database of all their state-owned unused, abandoned or
surplus property.

All agencies and authorities will be required to document and classify
the unused real property into the inventory database. Through the use of
an industry standard asset management tool known as facility condition
index (FCI), the great state of New York can have a much clearer view of
their assets at hand and can explore ways to revitalize or repurpose
them.

 AN ACT to amend the executive law, in relation to establishing an inven-
   tory database to track the state's  inventory  of  unused  state-owned
   real property

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The executive law is amended by adding a new section  202-b
 to read as follows:
   §  202-B. INVENTORY DATABASE. 1.  THE OFFICE OF GENERAL SERVICES SHALL
 ESTABLISH AND MAINTAIN AN INVENTORY DATABASE TO TRACK THE STATE'S INVEN-
 TORY OF UNUSED STATE-OWNED REAL PROPERTY, AND SHALL POST A LIST OF  SUCH
 INVENTORY  OF  UNUSED  STATE-OWNED  REAL  PROPERTY  ON ITS WEBSITE. SUCH
 INVENTORY LIST  SHALL  BE  UPDATED  QUARTERLY.  THE  COMMISSIONER  SHALL
 PROVIDE  ALL STATE AGENCIES WITH ACCESS TO SUCH INVENTORY DATABASE, WITH
 NECESSARY TECHNICAL SUPPORT PROVIDED, AT COST.  THE  INVENTORY  DATABASE
 SHALL  SERVE  AS  THE  SYSTEM  OF RECORD FOR ALL UNUSED STATE-OWNED REAL
 PROPERTY. ALL STATE AGENCIES SHALL PROVIDE SUFFICIENT INFORMATION TO THE
 OFFICE OF GENERAL SERVICES TO ENSURE THAT THEIR INVENTORY OF REAL  PROP-
 ERTY IS ENTERED INTO THE INVENTORY DATABASE.
   2.  THE  INVENTORY DATABASE SHALL, AT A MINIMUM, INCLUDE THE FOLLOWING
 FOR EACH UNUSED STATE-OWNED REAL PROPERTY LISTED IN SUCH INVENTORY DATA-
 BASE:
   (A) THE NAME OF THE STATE AGENCY THAT OWNS SUCH PROPERTY;
   (B) THE NAME OF THE BUILDING/FACILITY ON SUCH PROPERTY;
   (C) THE LOCATION;
   (D) A DESCRIPTION;
   (E) ANY REPURPOSE POTENTIAL;
   (F) GROSS SQUARE FEET;
   (G) THE DATE BUILT; AND
   (H) THE FACILITY CONDITION INDEX.

   3. EACH STATE AGENCY SHALL, NO LATER THAN THIRTY DAYS AFTER THE EFFEC-
 TIVE DATE OF THIS SECTION, ASSIGN AN EMPLOYEE TO SERVE AS ITS  INVENTORY
 COORDINATOR. INVENTORY COORDINATORS SHALL BE TASKED WITH DOCUMENTING ALL
 UNUSED  STATE-OWNED  REAL  PROPERTY  OWNED  BY THEIR STATE AGENCY IN THE
 INVENTORY  DATABASE, AND SHALL PROVIDE UPDATED INFORMATION TO THE INVEN-
 TORY DATABASE QUARTERLY. INVENTORY COORDINATORS SHALL BE  GIVEN  MANAGE-
 MENT SUPPORT AND PROVIDED WITH THE NECESSARY RESOURCES TO ENABLE THEM TO
 COMPLY WITH THIS SECTION.
   4.  EACH STATE AGENCY MAY CREATE AN INVENTORY TEAM IN-HOUSE TO PROVIDE
 THE OFFICE OF GENERAL SERVICES WITH THE INFORMATION REQUIRED PURSUANT TO
 THIS SECTION. SUCH INVENTORY TEAM  SHALL  BE  COMPRISED  OF  APPROPRIATE
 STAFF  INVOLVED  IN IDENTIFYING AND DOCUMENTING ALL UNUSED PROPERTY. THE
 HEAD OF AN INVENTORY TEAM SHALL BE THE INVENTORY  COORDINATOR  FOR  SUCH
 STATE AGENCY.
   5.  THE  COMMISSIONER  OF  GENERAL SERVICES SHALL DESIGN AND IMPLEMENT
 TRAINING FOR INVENTORY COORDINATORS AND INVENTORY TEAMS. THE COMMISSION-
 ER SHALL ALSO ESTABLISH THE APPROPRIATE METRICS FOR  FACILITY  CONDITION
 INDEXING OF THE REAL PROPERTY LISTED IN THE INVENTORY DATABASE.
   6. (A) EACH STATE AGENCY SHALL FURNISH SUCH INFORMATION AS THE COMMIS-
 SIONER  DETERMINES  IS  REASONABLY  NECESSARY  TO  PROPERLY MAINTAIN THE
 INVENTORY DATABASE. EACH STATE AGENCY SHALL SHARE DATA IN THE MOST EFFI-
 CIENT MANNER IDENTIFIED BY THE COMMISSIONER FOR  PURPOSES  OF  INFORMING
 ANY  PROGRESS  REPORTS.  EACH STATE AGENCY SHALL FOLLOW APPLICABLE STATE
 DATA GOVERNANCE PROCEDURES REGARDING ANY  INTERAGENCY  DATA  SHARING  OR
 COLLECTION.
   7. FOR THE PURPOSE OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE
 FOLLOWING MEANINGS:
   (A) "COMMISSIONER" MEANS THE COMMISSIONER OF GENERAL SERVICES.
   (B) "INVENTORY COORDINATOR" MEANS AN INVENTORY COORDINATOR TASKED WITH
 DOCUMENTING  UNUSED  STATE-OWNED  REAL PROPERTY IN THEIR STATE AGENCY IN
 THE INVENTORY DATABASE PURSUANT TO SUBDIVISION THREE OF THIS SECTION.
   (C) "INVENTORY DATABASE" MEANS THE DATABASE OF UNUSED STATE-OWNED REAL
 PROPERTY CREATED PURSUANT TO SUBDIVISION ONE OF THIS SECTION.
   (D) "INVENTORY TEAM" MEANS A  STATE  AGENCY'S  IN-HOUSE  TEAM  CREATED
 PURSUANT TO SUBDIVISION FOUR OF THIS SECTION.
   (E)  "STATE  AGENCY"  MEANS EVERY AGENCY OR AUTHORITY OF THE STATE, OR
 ANY DEPARTMENT, DIVISION, OFFICE OR OTHER UNIT THEREOF.
   § 2. This act shall take effect immediately.
