 Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to amend the public health law, in relation to requiring insurers
   participating in the NY state of health marketplace to offer at  least
   one dental plan for individuals age 65 and older

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subparagraph (ii) of paragraph  (a)  of  subdivision  1  of
 section  268-d of the public health law, as added by section 2 of part T
 of chapter 57 of the laws of 2019, is amended to read as follows:
   (ii) offers at least one qualified health plan and/or other  or  addi-
 tional  health  plans authorized for sale by the department of financial
 services or the department in each of the  silver  and  gold  levels  as
 required  by  state law AND OFFERS AT LEAST ONE QUALIFIED DENTAL PLAN OR
 DENTAL PLAN APPROVED FOR SALE BY THE DEPARTMENT  OF  FINANCIAL  SERVICES
 AND/OR   THE  DEPARTMENT  FOR  INDIVIDUALS  AGE  SIXTY-FIVE  AND  OLDER,
 provided, however, that the Marketplace may require  additional  benefit
 levels to be offered by all insurers participating in the Marketplace;
   §  2. This act shall take effect on the first of January next succeed-
 ing the date on which it shall have become a law.
