BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the penal law, in relation to staging a motor vehicle accident in the second degree THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 176.75 of the penal law, as added by chapter 151 of the laws of 2019, is amended to read as follows: § 176.75 Staging a motor vehicle accident in the second degree. A person is guilty of staging a motor vehicle accident in the second degree when, with intent to commit and in furtherance of a fraudulent insurance act, he or she operates a motor vehicle and intentionally causes a collision involving a motor vehicle, OR DIRECTS, HIRES, REQUESTS, ENCOURAGES, ORCHESTRATES, OR INVITES ANOTHER TO CAUSE A COLLI- SION INVOLVING A MOTOR VEHICLE. Staging a motor vehicle accident in the second degree is a class E felony. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13599-01-3
