TITLE OF BILL:

An act to amend the public health law, in relation to requiring public
hospitals to establish auto-immune disease treatment centers

 
PURPOSE:

This bill aims to launch the Auto-Immune Disease Treatment Center
project

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1: Details the arrangement of the auto-immune disease treatment
center project between hospitals, Commissioner of Health and the Office
of Health Equity.

Section 2: This act shall take effect on the hundred twentieth day after
it shall have become law. Effective immediately, the addition, amendment
and/or repeal of any rule or regulation necessary for the implementation

of this act on its effective date are authorized to be made on or before
such effective date.

 
JUSTIFICATION:

There is an increasing prevalence of autoimmune diseases and the need
for specialized centers to address the unique challenges they pose.
Underserved communities are even more marginalized when access to care
is not widespread and standardized.

Benefits of such a center include comprehensive care, research opportu-
nities, economic impact, improved patient outcomes, education and aware-
ness and immediate and long-term statewide impact.

EFFECTIVE DATE:
This act shall take effect on the hundred twentieth day after it shall
have become law. Effective immediately, the addition, amendment and/or

such effective date.

 AN ACT to amend the public health law, in relation to  requiring  public
   hospitals to establish auto-immune disease treatment centers
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 2807-g to read as follows:
   §  2807-G.  AUTO-IMMUNE DISEASE TREATMENT CENTERS. 1. FOR THE PURPOSES
 OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   (A) "AUTO-IMMUNE DISEASE TREATMENT  CENTER  PROJECT"  SHALL  MEAN  THE
 CONSTRUCTION,  RECONSTRUCTION, RENOVATION, REHABILITATION, REFURBISHING,
 EXPANSION, UPGRADING, OR EQUIPPING OF AN AUTO-IMMUNE  DISEASE  TREATMENT
 CENTER.
   (B)  "HOSPITAL" SHALL MEAN A PUBLIC HOSPITAL LOCATED IN THE STATE THAT
 IS OPERATED BY A COUNTY OR MUNICIPALITY AND RECEIVES STATE  FUNDING  FOR
 ITS OPERATIONS.
   2.  THE  COMMISSIONER  SHALL  REQUIRE THAT ALL HOSPITALS AS DEFINED IN
 THIS SECTION SHALL ESTABLISH AND IMPLEMENT AN AUTO-IMMUNE DISEASE TREAT-
 MENT CENTER.
   3. (A) THE COMMISSIONER IS AUTHORIZED TO MAKE FUNDS OF THE  DEPARTMENT
 AVAILABLE   TO   HOSPITALS  FOR  AUTO-IMMUNE  DISEASE  TREATMENT  CENTER
 PROJECTS.
   (B) SUCH FUNDS MAY BE PROVIDED PURSUANT TO THE PROVISIONS  OF  SECTION
 TWENTY-EIGHT  HUNDRED  TWENTY-SIX OF THIS ARTICLE OR ANY OTHER PROVISION
 OF LAW OR REGULATION DEEMED TO BE APPROPRIATE BY  THE  COMMISSIONER  FOR
 CARRYING OUT THE PURPOSES OF THIS SECTION.
   4.  THE OFFICE OF HEALTH EQUITY, AS ESTABLISHED BY SECTION TWO HUNDRED
 FORTY-ONE AS AMENDED BY CHAPTER 523 OF THE LAWS OF 2022, OF  THIS  CHAP-
 TER,  SHALL  ASSIST THE COMMISSIONER IN ALLOCATING AND DISTRIBUTING SUCH

 FUNDS PURSUANT TO SUBDIVISION TWO OF THIS SECTION, INCLUDING THE  DEVEL-
 OPMENT OF A METHODOLOGY OR PROCEDURE THEREFOR.
   5.  THE COMMISSIONER SHALL PROMULGATE ANY RULES AND REGULATIONS NECES-
 SARY TO EFFECTUATE THE PROVISIONS OF THIS SECTION.
   6. THE COMMISSIONER SHALL REPORT ANNUALLY  TO  THE  GOVERNOR  AND  THE
 LEGISLATURE  ALL  MONIES  ALLOCATED  AND  DISTRIBUTED  PURSUANT  TO THIS
 SECTION.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation of this act on its effective date are authorized to be made on or
 before such effective date.
