BILL NUMBER: S7784 SPONSOR: WEBB TITLE OF BILL: An act to amend the social services law, in relation to the fingerprint- ing of prospective employees of child day care centers PURPOSE: To allow the State Education Department (SED) to share the background check results of individuals who have had their fingerprints taken by SED and who are applying for employment at child day care centers or school age child care providers SUMMARY OF PROVISIONS: Section one amends the social services law to exempt child day care centers and school age child care providers from the requirement that they obtain a prospective employee's fingerprints when SED has already forwarded them to the Office of Children and Family Services (OCFS).

WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to the fingerprint- ing of prospective employees of child day care centers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 9 of section 390-b of the social services law is amended by adding a new paragraph (c) to read as follows: (C) NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, UPON REQUEST FROM A PROSPECTIVE EMPLOYEE OR VOLUNTEER WHO HAS BEEN CLEARED BY THE COMMISSIONER OF EDUCATION PURSUANT TO SECTION THREE THOUSAND THIR- TY-FIVE OF THE EDUCATION LAW, THE DEPARTMENT OF EDUCATION SHALL BE AUTHORIZED TO FORWARD A COPY OF SUCH INDIVIDUAL'S CRIMINAL HISTORY RECORD AND SUCH INDIVIDUAL'S FINGERPRINTS TO THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES FOR PURPOSES OF CONDUCTING A CRIMINAL HISTORY RECORD CHECK PURSUANT TO THIS SECTION. FURTHERMORE, UPON NOTIFICATION THAT SUCH PROSPECTIVE EMPLOYEE HAS BEEN CLEARED FOR EMPLOYMENT BY THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES PURSUANT TO THIS SECTION, THE DIVISION OF CRIMINAL JUSTICE SERVICES SHALL HAVE THE AUTHORITY TO PROVIDE SUBSEQUENT CRIMINAL HISTORY NOTIFICATIONS DIRECTLY TO SUCH COMMISSIONER. § 2.
