BILL NUMBER: S7793 SPONSOR: PERSAUD TITLE OF BILL: An act to amend part DD of chapter 57 of the laws of 2023 establishing a cost of living adjustment for designated human services programs, in relation to programs that are eligible for a cost of living adjustment PURPOSE: This bill would cover a wider breadth of contracted human services work- ers eligible for the human services annual cost of living adjustment (COLA) by adding previously missing programs to New York State's desig- nated human services programs eligible for the COLA. SUMMARY OF PROVISIONS: Section 1 amends part DD of chapter 57 of the laws of 2023-2024 estab- lishing a cost-of-living adjustment for designated human services programs, in relation to programs that are eligible for a cost-of-living adjustment. PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend part DD of chapter 57 of the laws of 2023 establishing a cost of living adjustment for designated human services programs, in relation to programs that are eligible for a cost of living adjustment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1 of part DD of chapter 57 of the laws of 2023 establishing a cost of living adjustment for designated human services programs is amended to read as follows: Section 1. 1. Subject to available appropriations and approval of the director of the budget, the commissioners of the office of mental health, office for people with developmental disabilities, office of addiction services and supports, office of temporary and disability assistance, office of children and family services, [and] the state office for the aging, THE STATE EDUCATION DEPARTMENT, THE DEPARTMENT OF HEALTH, AND THE DIRECTOR OF THE OFFICE OF VICTIM SERVICES, shall estab- lish a state fiscal year 2023-24 cost of living adjustment (COLA), effective April 1, 2023, for projecting for the effects of inflation upon rates of payments, contracts, or any other form of reimbursement for the programs and services listed in paragraphs (i), (ii), (iii), (iv), (v), and (vi) of subdivision four of this section. The COLA established herein shall be applied to the appropriate portion of reim- bursable costs or contract amounts. Where appropriate, transfers to the department of health (DOH) shall be made as reimbursement for the state share of medical assistance. 2. Notwithstanding any inconsistent provision of law, subject to the approval of the director of the budget and available appropriations therefore, for the period of April 1, 2023 through March 31, 2024, the commissioners AND DIRECTORS shall provide funding to support a four percent (4.0%) cost of living adjustment under this section for all EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
