BILL NUMBER: S8021 SPONSOR: FERNANDEZ TITLE OF BILL: An act to amend the state technology law, in relation to state agency websites required to offer a mobile friendly form PURPOSE: This is a chapter amendment that makes changes to the provisions of L.2023 c.765, to clarify when compliance is required and require full compliance by January 1, 2027. SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by clarifying that websites must comply where there is a change to form or function. The change to form or function is defined as modifications to aspects of the website. The amendment requires all agency websites to be compliant by January 1, 2027.

FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the state technology law, in relation to state agency websites required to offer a mobile friendly form THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 210 of the state technology law, as added by a chapter of the laws of 2023 amending the state technology law relating to state agency websites, as proposed in legislative bills numbers S. 5410 and A. 6972, is renumbered section 103-c and amended to read as follows: § 103-c. State agency websites; mobile friendly websites. All state agency websites, as defined in section two hundred two of this [article] CHAPTER, shall offer a mobile friendly form and shall be made available for all mobile devices that support such technology, PROVIDED THAT SUCH REQUIREMENT SHALL ONLY APPLY TO WEBSITES CREATED OR MODIFIED WITH CHANG- ES TO FORM OR FUNCTION AFTER THE EFFECTIVE DATE OF THIS SECTION AND PRIOR TO JANUARY FIRST, TWO THOUSAND TWENTY-SEVEN, AND TO ALL STATE AGENCY WEBSITES THEREAFTER. For the purposes of this section, "mobile friendly" shall mean, with respect to a website, that such website is configured in such a way that such website may be navigated, viewed and accessed on a smartphone, tablet computer, or similar mobile device. FOR THE PURPOSES OF THIS SECTION, "CHANGES TO FORM OR FUNCTION" SHALL MEAN MODIFICATIONS TO THE VISUAL PRESENTATION, INFORMATIONAL ORGANIZATION, WEBSITE INFRASTRUCTURE, OR USER UTILITY OF THE WEBSITE, INCLUDING BUT NOT LIMITED TO: 1. REDESIGNS OF SITE LAYOUT, COLOR SCHEMES, GRAPHICS, BRANDING ELEMENTS, OR OTHER AESTHETIC COMPONENTS; OR 2. INTEGRATION OF DYNAMIC INTERFACES. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2023 amending the state technology law relating to state agency websites, as proposed in legislative bills numbers S. 5410 and A. 6972, takes effect.
