BILL NUMBER: S8046 SPONSOR: CLEARE TITLE OF BILL: An act to amend the elder law, in relation to the naturally occurring retirement community supportive service program PURPOSE: This is a chapter amendment that makes changes to provisions of L.2023, c.661, to clarify that the data being collected, by NYSOFA, is from residents in naturally occurring retirement communities who participate in a program or receive services through a naturally occurring retire- ment community (NORC). SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by clarifying that the data required to be collected by the Director of the New York State Office for the Aging ("NYSOFA"), when conducting its study and report on the number of older adults residing in NORC's, is from residents of a

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the elder law, in relation to the naturally occurring retirement community supportive service program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1 of a chapter of the laws of 2023 amending the elder law relating to the naturally occurring retirement community supportive service program, as proposed in legislative bills numbers S. 5907 and A. 5520, is amended to read as follows: Section 1. The state office for the aging is authorized and directed to conduct a study on the number of older adults residing in naturally occurring retirement communities or neighborhood naturally occurring retirement communities who are suffering from social isolation and lone- liness. Such study shall include, but not be limited to the number of members of such communities suffering from social isolation or loneli- ness BASED ON DATA COLLECTED FROM THOSE RESIDENTS PARTICIPATING IN PROGRAMS OR SERVICES PROVIDED UNDER SECTION 209 OF THE ELDER LAW, current programs or services seeking to alleviate these conditions, and additional programs or services that could be implemented. § 2. Subdivision 8 of section 209 of the elder law, as amended by a chapter of the laws of 2023 amending the elder law relating to the naturally occurring retirement community supportive service program, as proposed in legislative bills numbers S. 5907 and A. 5520, is amended to read as follows: 8. On or before March first, two thousand nineteen, and every five years thereafter, the director shall report to the governor and the finance committee of the senate and the ways and means committee of the assembly concerning the effectiveness of the naturally occurring retire- ment community supportive services program in achieving the objectives set forth by this section, which include helping to address the needs of residents in such classic and neighborhood naturally occurring retire- ment communities, assuring access to a continuum of necessary services, increasing private, philanthropic and other public funding for programs, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
