BILL NUMBER: S8534 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting the use of virtual reality devices while operating a motor vehicle PURPOSE OF BILL: To prohibit the use of virtual reality devices while operating a motor vehicle. SUMMARY OF SPECIFIC PROVISIONS: Section one amends Subdivision 1 and paragraphs (a) and (b) of subdivi- sion 2 of section 1225-d of the vehicle and traffic law. Subdivision one is amended to prohibit the use of portable electronic devices that obstruct a motorists vision. Paragraph (a) of subdivision 2 is amended to include virtual and augmented reality devices in the definition of "portable electronic device". Paragraph (B) is amended to define the term "using" to include wearing portable electronic devices.

HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to prohibiting the use of virtual reality devices while operating a motor vehicle THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 and paragraphs (a) and (b) of subdivision 2 of section 1225-d of the vehicle and traffic law, subdivision 1 as amended by section 6 and paragraphs (a) and (b) of subdivision 2 as amended by section 8 of part C of chapter 58 of the laws of 2013, are amended to read as follows: 1. Except as otherwise provided in this section, no person shall oper- ate a motor vehicle while using any portable electronic device while such vehicle is in motion; NOR SHALL A PERSON USE ANY PORTABLE ELECTRON- IC DEVICE THAT OBSTRUCTS THEIR VISION, IN FULL OR IN PART, WHILE OPERAT- ING SUCH VEHICLE; provided, however, that no person shall operate a commercial motor vehicle while using any portable electronic device on a public highway including while temporarily stationary because of traf- fic, a traffic control device, or other momentary delays. Provided further, however, that a person shall not be deemed to be operating a commercial motor vehicle while using a portable electronic device on a public highway when such vehicle is stopped at the side of, or off, a public highway in a location where such vehicle is not otherwise prohib- ited from stopping by law, rule, regulation or any lawful order or direction of a police officer. (a) "Portable electronic device" shall mean any hand-held mobile tele- phone, as defined by subdivision one of section twelve hundred twenty- five-c of this article, personal digital assistant (PDA), handheld device with mobile data access, laptop computer, pager, broadband personal communication device, two-way messaging device, electronic game, [or] portable computing device, VIRTUAL REALITY DEVICE, AUGMENTED REALITY DEVICE, or any other electronic device when used to input, write, send, receive, or read text for present or future communication. BILL NUMBER: S8534A SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting the use of virtual reality headsets while operating a motor vehicle PURPOSE: To enhance road safety by explicitly prohibiting the use of virtual reality (VR) and augmented reality (AR) devices that obstruct a driver's vision while operating a motor vehicle. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends Subdivision 24-a of section 1225-d of the vehicle and traffic law. The term "portable electronic device" is expanded to explicitly include virtual reality headsets and similar devices. Addi- tionally, it becomes unlawful to operate any motor vehicle, limited use automobile, motorcycle, or bicycle while wearing a virtual reality head- set.

HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the vehicle and traffic law, in relation to prohibiting the use of virtual reality headsets while operating a motor vehicle THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 24-a of section 375 of the vehicle and traffic law, as added by chapter 604 of the laws of 1983, is amended to read as follows: 24-a. It shall be unlawful to operate upon any public highway in this state a motor vehicle, limited use automobile, limited use motorcycle or bicycle while the operator is wearing more than one earphone attached to a radio, tape player or other audio device OR IS WEARING A VIRTUAL REAL- ITY HEADSET. § 2. This act shall take effect on the sixtieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
